Family alleges criminal conspiracy in bank branch manager murder case
Jakarta (ANTARA) - The family of a bank branch manager, identified by the initials MIP (37), believes there were elements of criminal conspiracy among the defendants in the kidnapping and murder case of MIP.
“It is difficult for us to say there was no element of mens rea (intent) regarding a criminal conspiracy,” said MIP’s brother, Taufante, to journalists following the sentencing hearing at the Military Court II-08 Jakarta on Monday.
Taufan stated that the family is not satisfied with the sentences proposed by the Military Prosecutor in the alleged kidnapping and murder case of MIP. “Because it involves many parties and took place over a period of time that was deemed sufficient to prevent the loss of life,” he said.
On the other hand, Taufan stated that while the family respects the ongoing legal process, they feel the proposed sentences do not meet the requirements of justice. According to him, the case is a serious crime that should not be viewed as an ordinary matter.
“It involves many people, including individuals from a special unit within an institution that is actually very honourable. And of course, it would be very convenient if the punishment were very light,” Taufan explained. “Looking at the planning, there was time to save him, to rethink many times. Even just to abort the criminal conspiracy—why was the deceased not sent to the hospital? Those five minutes were the golden time,” added Taufan.
He stated that the family will continue to monitor the legal process alongside their legal team to ensure a verdict that is considered appropriate. Taufan hopes that the case involving his brother will receive serious attention from law enforcement agencies and relevant institutions to prevent similar incidents from occurring in the future. “This is for all of us, so that this crime does not happen again in the future,” said Taufan.
During the sentencing hearing at the Military Court, the first defendant, Serka Mochamad Nasir, was sentenced to 12 years in prison, minus time already served. The second defendant, Kopda Feri Herianto, was sentenced to 10 years in prison, minus time already served, while the third defendant, Serka Frengky Yaru, was sentenced to four years in prison. Additionally, the first and second defendants also face the additional penalty of dishonourable discharge from the Indonesian Army (TNI AD).
