The Corruption Eradlarication Commission (KPK) has stated that it will maximise the criminal penalties against the Chairman of the Golkar Party DPP, Fahd El Fouz, also known as Fahd A Rafiq. This decisive step follows the individual achieving a ‘hat-trick’, being named a suspect in a corruption case for the third time.

“We will maximise the sentencing for FF (Fahd), as this is now his third instance,” said the Acting Director of Investigations at the KPK, Achmad Taufik Husein, at the KPK Red and White Building, Jakarta, on Tuesday (15/9).

Taufik emphasised that the KPK is striving to maximise criminal sanctions because his status as a recidivist means Fahd A Rafiq’s legal position could potentially lead to a much heavier sentence. “In legal concept, a recidivist certainly faces a heavier penalty than someone committing a criminal act for the first time,” he noted.

In this third case, the KPK has named Fahd A Rafiq as a suspect in alleged corruption within the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN). Fahd, alongside the former Regent of Kebumen, Arif Sugiyanto, and two private parties, Erwin and Muhammad Fakhry, are alleged to be trusted associates of the Minister of ATR/BPN, Nusron Wahid.

In addition to these four individuals, the KPK has also named several other officials and private parties as suspects. To prevent similar cases from recurring, the commission asserts that maximum sanctions, including the seizure of assets to impoverish perpetrators, must be implemented. Investigators are continuing to probe the origins, allocation, flow, and the parties suspected of receiving or delivering the funds.

The KPK stated that the summoning of Minister of ATR/BPN Nusron Wahid regarding the alleged corruption within the Ministry of ATR/BPN will depend on the investigators’ requirements.
