Fahd A Rafiq a Corruption Recidivist, Severe Sanctions Await
The Corruption Eradication Commission (KPK) has asserted that it will pursue more severe prosecution against the suspect in the alleged bribery case involving the processing of Building Use Rights (HGB), Fahd El Fouz, also known as Fahd A Rafiq. He is identified as a trusted associate of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN), Nusron Wahid.
This is because the alleged HGB bribery case marks the third corruption case involving Fahd. The Acting Director of Investigations at the KPK, Achmad Taufik Husein, explained that based on criminal law concepts, Fahd is a recidivist.
“There will certainly be an aggravation of the sentence,” Taufik stated during a press conference at the KPK Red and White Building, Jakarta, on Tuesday night (15/9).
A recidivist status is one of the grounds for aggravating criminal penalties, where the sentence is increased by one-third of the maximum penalty. The aggravation of punishment for a recidivist applies when the requirements for recidivism (repetition of crime) are met.
Taufik added that investigators will further probe Fahd’s role or involvement in the alleged corruption case regarding the processing of HGB for PT Summarecon Agung Tbk in Bogor Regency. “The determination of the sentence will be part of the prosecution’s portion. However, in terms of legal concepts, a recidivist certainly faces heavier consequences than someone committing a criminal act for the first time,” Taufik explained.
The KPK has named eight individuals as suspects in the alleged bribery case involving HGB processing at PT Summarecon Agung Tbk in Bogor Regency and other related matters within the Ministry of ATR/BPN. The suspects have been detained in prison for the initial 20-day period until 4 October 2026.
Four of the eight suspects are alleged by the KPK to be trusted associates of Nusron Wahid. These include the former Regent of Kebumen, Arif Sugiyanto; Golkar Party politician, Fahd El Fouz (Fahd A Rafiq); Erwin (private sector); and Muhammad Fakhry (private sector).
The other four suspects undergoing legal proceedings are the Head of the Bogor Regency Land Office, Sontang Coin Manurung; President Director of PT Summarecon Agung Tbk, Adrianto Pitojo Adhi; the Director General of Land and Spatial Control and Enforcement at the Ministry of ATR/BPN, Lampri; and Rizal Pahlevi (private sector).
Adrianto Pitojo Adhi, together with Rizal Pahlevi as the alleged bribe givers, is charged with corruption as regulated under Article 605 paragraph (1) letter a or b of Law Number 1 of 2023 regarding the Criminal Code (KUHP) in conjunction with Article VII number 48 of Law Number 1 of 2026 regarding Criminal Law Adjustment, or Article 606 paragraph (1) of the KUHP in conjunction with Article VII number 49 of the Criminal Law Adjustment Law and Article 20 of the KUHP.
Meanwhile, Sontang, together with Erwin, and Lampri, together with Arif Sugiyanto, Fahd A Rafiq, and Muhammad Fakhry, are charged with corruption as regulated under Article 12 letter a or letter b and/or Article 12 B of the Law on the Eradication of Corruption Crimes (UU Tipikor) or Article 606 paragraph (2) of the KUHP in conjunction with Article VII number 49 of the Criminal Law Adjustment Law and Article 20 of the KUHP.
