Fabrie Could Be Forcibly Picked Up If He Skips Summons Again

Abdul Fickar Hadjar, a legal observer at Trisakti University, has asserted that Febrie Adriansyah, the former Junior Attorney General for Special Crimes (Jampidsus) at the Attorney General’s Office, can be forcibly brought in if he again fails to respond to investigators’ summons.

“If he is summoned twice and does not appear without a valid reason, then legally the suspect can be directly fetched by force,” Fickar stated in response to Febrie’s absence from questioning at the Attorney General’s Office on Friday (24/7).

Previously, Febrie Adriansyah did not answer a summons from investigators in a money laundering (TPPU) case related to the discovery of 74 kilograms of gold and cash at his residence. Febrie was unable to attend on the grounds of his health condition.

Referring to the Criminal Procedure Code (KUHAP), Abdul Fickar argued that a suspect’s claim of illness cannot be taken at face value, as investigators have the authority to arrange a second opinion by bringing in a doctor of their own choosing.

This means, Fickar continued, that if a written excuse such as a medical certificate seems dubious, investigators can bring in a doctor to examine him directly.

“And if it is proven that there is no health problem that would genuinely hinder the examination, he can be brought in immediately,” Fickar said.

Fickar further expressed regret at Febrie’s attitude, which he considered to give the impression of evading the legal process through various excuses. In his view, as a former law enforcement official, Febrie should set an example by being cooperative.

“He certainly understands how the legal process works. So it would be best for him to go through the process and prove that he is indeed innocent,” he said.

It is understood that the Junior Attorney General for Supervision (Jamwas) at the Attorney General’s Office, Rudi Margono, explained that on Friday (24/7) the Attorney General’s Office once again summoned Febrie Adriansyah for questioning.

However, if Febrie fails to appear for this second summons, investigators at the Attorney General’s Office will take forcible measures to bring him in.

“If he does not appear, in accordance with Article 28 of the Criminal Procedure Code, investigators, with the assistance of authorised officials, may bring him in by coercive means,” said Rudi Margono.
