Fabrie Could Be Forcibly Picked Up If He Skips Summons Again
Trisakti University legal observer Abdul Fickar Hadjar has stressed that former Junior Attorney General for Special Crimes (Jampidsus) Febrie Adriansyah can be forcibly picked up if he again fails to comply with an investigator’s summons. “If he is summoned twice and does not attend without a valid reason, then legally the suspected perpetrator can be immediately picked up forcibly,” Fickar asserted in response to Adriansyah’s absence from an examination at the Attorney General’s Office on Friday (24/7). Previously, Adriansyah did not comply with an investigator’s summons in a case of alleged money laundering related to the discovery of 74 kilograms of gold and cash at his residence. Adriansyah was unable to attend, citing health reasons. Referring to the Criminal Procedure Code (KUHAP), Abdul Fickar argued there is no reason for a suspect to claim illness. He noted that investigators have the authority to conduct a comparison by bringing in a doctor from the investigator’s own office. Fickar explained that if a written excuse, such as a sick note, is deemed suspicious, investigators can immediately bring a doctor to conduct a direct examination. “And if it is proven that there is no health problem (illness) that would disrupt or hinder the examination, he can be brought in immediately,” Fickar said. Furthermore, Fickar expressed regret over Adriansyah’s attitude, which he considered to be an attempt to avoid the legal process through various excuses. He stated that as a former law enforcement official, Adriansyah should set an example by being cooperative. “He certainly understands the legal process. So he should just go through with it and prove his innocence,” he said. The Junior Attorney General for Supervision (Jamwas), Rudi Margono, explained that the Attorney General’s Office had again summoned Febrie Adriansyah for examination on Friday (24/7). However, if Adriansyah fails to appear for this second summons, investigators will take steps to forcibly bring him in. “If he does not attend, in accordance with Article 28 of the Criminal Procedure Code, investigators with the assistance of authorised officials can present him through coercive measures,” said Rudi Margono.
