Expert Witness Absence Delays Illegal Access Trial
The continuation of the trial for the alleged illegal access case against the server of PT Indodax Nasional Indonesia, with defendant Deflorio Arya Nizam, was adjourned by the Panel of Judges at the South Jakarta District Court on Monday (27/7/2026). The adjournment occurred due to the absence of the expert witness presented by the Public Prosecutor (JPU).
The defendant’s legal counsel, Wa Ode Nur Zainab, used the adjournment to formally object to irregularities in the expert witness’s official investigation report (BAP) from the investigators.
"We object to the expert presented by the JPU. The expert’s BAP and the oath-taking minutes are dated 5 June 2024. Meanwhile, the police report (LP) was only issued on 10 October 2024. This means it is not just an ordinary backdating, it could be part of a scenario," Wa Ode said after the hearing.
Beyond the alleged irregularity in the BAP document dating, Wa Ode assessed that investigators appeared to be building a tendentious narrative not supported by strong evidence throughout the series of hearings. She questioned the relevance of the expert’s opinion if it is based on assumptions or legal facts that have not yet been proven.
Wa Ode also complained that the trial adjournments were further prolonging the legal uncertainty for her client, given that Deflorio Arya Nizam has been in detention since mid-May 2026.
"The trial is being delayed in such a manner. This is very detrimental because there is no immediate legal certainty for our client," she stressed.
