Expert: Prosecutor's Office must examine all parties linked to PU corruption
Jakarta (ANTARA) - Criminal law expert Abdul Fickar Hadjar has asked the prosecutor’s office not to hesitate in examining all parties connected to the alleged corruption in the renovation of the ground floor of the Cipta Karya Building at the Ministry of Public Works.
The examination must reach officials who knew about or were responsible for the project.
“If the event is already clear, then it is determined who the suspect is, namely the person most responsible for the state losses that arose and who enjoyed them,” said Fickar in a statement in Jakarta on Thursday.
He therefore urged that an investigation be carried out immediately to confirm that the corruption incident did indeed occur.
If the criminal act of corruption is confirmed, he continued, the case can be escalated to a full investigation to obtain statements from witnesses and collect related documents or items.
Once the case structure has been established, Fickar said investigators must seek the party most responsible for the state losses. The naming of a suspect must be supported by sufficient evidence.
In this case, the DKI Jakarta High Prosecutor’s Office has detained an official from the Secretariat of the Directorate General of Cipta Karya.
The name of Deputy Minister of Public Works Diana Kusumastuti has also come under scrutiny because she served as Director General of Cipta Karya when the 2023 fiscal year project was carried out.
However, Diana, as Director General of Cipta Karya at the time the project was running, has never been asked for information.
“All related parties, including the secretary of the directorate general, the director general, the deputy minister, or even the minister himself if he indeed knew in the sense of seeing, hearing, feeling, or perhaps even participated,” said the Trisakti University Faculty of Law lecturer.
Fickar thus stressed that the status of deputy minister does not make someone immune from legal process.
If investigators have obtained at least two pieces of evidence, he continued, a summons and even the naming of a suspect against someone can be carried out.
The case relates to alleged corruption in fictitious projects within the Secretariat of the Directorate General of Cipta Karya for the 2023–2025 period.
Previously, the DKI Jakarta High Prosecutor’s Office had named and detained a new suspect with the initials JND in connection with alleged corruption in the implementation of routine spending at the Secretariat of the Directorate General of Cipta Karya of the Ministry of Public Works for the 2023–2024 period in Jakarta on Monday (6/7).
JND is the Director of PT CV Asaykhana as well as the controller of a number of companies, including CV Nalisa Destia, CV Mila Kirana, CV Raflindo Pratama, PT Atrindo Prima Persada, CV Nursa Lima, CV Zafran Karya Utama, CV Azio Osaka and CV Ardian Permata Indah.
JND is strongly suspected of working together with other suspects to engineer fictitious projects at the Cipta Karya Directorate General Secretariat for the 2023 and 2024 periods, namely SKN and MT, who are employees of the Directorate General of Cipta Karya at the Ministry of Public Works.
