The ruling states political parties failing to meet the 30% female candidate quota may be disqualified from specific electoral districts. ‘Partially granting the petitioners’ request,’ said Constitutional Court Chief Justice Suhartoyo in the ruling on 25 May 2026. The petitioners—Maya Novita Sari, Imas Dion Febriani, Cahya Camila Evanglin, and Fatati Nailul Munadia—sought clear sanctions for political parties breaching Article 245 of the Election Law. The Court deemed the petitioners’ arguments legally valid in part, necessitating sanctions to ensure the 30% female legislative candidate quota is implemented. ‘The KPU at all levels must disqualify political parties from electoral districts that fail to meet the minimum 30% female representation quota,’ stated Justice Adies Kadir. He added that imposing sanctions on parties failing to meet the quota aims to reduce discrimination, particularly in female representation in the House of Representatives and regional legislatures.
