East Jakarta Administration Withdraws Appeal Against Administrative Court Ruling in Star Padel Residents' Lawsuit
The East Jakarta Municipal Government (Pemkot) has decided to withdraw its appeal against a Jakarta State Administrative Court (PTUN) ruling that found in favour of residents regarding the Star Padel facility in Pulomas, Kayu Putih, Pulogadung, East Jakarta.
East Jakarta Mayor Munjirin explained that the decision to withdraw the appeal was reached following a leadership meeting (Rapim).
“It has been studied and discussed at the Rapim, and following directives, it was decided that we will prepare a letter withdrawing the appeal,” Munjirin said at City Hall, Central Jakarta, on Tuesday (24/2).
Munjirin stated that the appeal had initially been filed solely because the mayor’s office was deemed to lack the legal authority to revoke the Building Approval Permit (PBG) as mandated by the court ruling.
According to him, the mayor does not have the authority to revoke the permit because the execution of the Star Padel PBG revocation falls under the jurisdiction of the Regional Apparatus Organisation (OPD).
“Once the appeal withdrawal letter has been submitted, the ruling stipulates that the Mayor must revoke the PBG. However, the Mayor does not have the authority to do so. Therefore, this will be deliberated by the OPD that holds the authority to revoke the PBG,” he said.
“It has been discussed, and a separate OPD will handle the PBG revocation matter,” he added.
While awaiting the official decision and the OPD’s revocation process, the East Jakarta administration is also undertaking mediation efforts to address residents’ complaints regarding Star Padel’s ongoing operations.
“There will be deliberations between local residents, RT and RW heads, and the owner to find a resolution while waiting for the OPD to discuss the PBG revocation,” Munjirin said.
“So before the official ruling is formally issued, we will facilitate discussions between residents and the padel facility owner,” he added.
Regarding pressure from residents demanding the demolition of the Star Padel facility, Munjirin declined to speculate further.
He noted that the authority for enforcement action and the timeline for resolution rest entirely with the relevant OPD, which is currently conducting a thorough review in accordance with directives from the DKI Jakarta Governor.
