E-commerce platforms are now required to provide notification before making changes to service fees for businesses on their platforms. This notification must be given 90 days before the new terms take effect. The provision is contained in Minister of Micro, Small and Medium Enterprises Regulation Number 3 of 2026 concerning the Protection and Enhancement of Competitiveness of Micro and Small Enterprises in Trade Through Electronic Systems. Article 9 states that Electronic Trading System Operators (PPMSE) planning to change the type and amount of Digital-Based Partnership (KBD) fees must notify Micro and Small Enterprises (UMK) no later than 90 days before the change takes effect. The regulation also stipulates that UMKs may file objections regarding changes to the type and amount of these fees. Business owners can also request negotiation facilities from the minister. Negotiations are conducted to reach a mutual agreement between both parties regarding KBD fees. The outcome of these negotiations will be set out in an agreement that is binding for both UMKs and PPMSE. UMKs can apply for negotiation facilities through the ministry’s SAPA UMKM platform. Furthermore, the ministerial regulation governs the provision of incentives in the form of discounts to UMKs selling domestic products. Article 15, paragraph (1) explains that a service fee reduction of at least 50% is granted. The article states that in providing promotional and marketing incentives for domestic products, non-micro, small and medium enterprise PPMSEs are required to grant a service fee discount of at least 50% to verified UMKs that exclusively sell domestic products. Paragraph (3) outlines several exceptions to the service fee reduction, including ready-to-eat processed food products and electronic products manufactured by large domestic industries. Article 16 stipulates that service fee discounts can be granted to businesses selling domestic products based on a UMK application through the SAPA UMKM platform. Meanwhile, e-commerce platforms may suspend or refuse the provision of incentives if a UMK sells products other than domestic products. Business owners whose incentives are rejected or suspended may also submit clarifications and objections.
