DPR's Legislative Body Agrees to Make Population Administration Bill an Initiative Proposal, Setting Sanctions for Data Leaks

The Legislative Body (Baleg) of the House of Representatives (DPR RI) has agreed to make the bill on the Second Amendment to Law Number 23 of 2006 concerning Population Administration (the Population Administration Bill) an initiative proposal. The bill sets out sanctions for administrators who fail to protect an individual’s data.

The Chair of the Special Committee (Panja) for the Population Administration Bill, Martin Manurung, initially presented a number of substantive points from the drafting at a meeting in the Baleg room at the DPR building in Senayan, Jakarta, on Monday (7/9/2026). He said the bill covers improvements to the definition of personal data through to population administration based on an integrated digital active stelsel.

“Population administration based on an integrated digital active stelsel must be carried out by the central government, provincial governments and district/municipal governments,” said Martin.

The bill, he said, also provides for administrative sanctions against administrators who fail to protect population data. Notably, the criminal penalty for users and officials who unlawfully disseminate population data is set at six years.

“Second, the revision of the wording of Article 131 paragraph 2 as follows: administrators who fail to protect population data shall be subject to administrative sanctions in the form of a fine, the amount of which shall be determined by government regulation,” said Martin.

“Third, the improvement of criminal sanctions for users and officials who unlawfully disseminate population data in Article 138, set at six years,” he added.

He said the central government and the DPR, through its working organs, are obliged to monitor and evaluate the implementation of this law two years after its enactment.

“The leadership and members of the Legislative Body and the proposing representatives, based on the technical aspects of formulation, the substance of the bill and the principles of law-making, the Panja is of the view that the bill on Population Administration has been fully deliberated at the Panja level, and the Panja submits its decision to the plenary of the Legislative Body at this time,” he added.

Each faction in the DPR then expressed its views on the Population Administration Bill. The Chair of the DPR’s Legislative Body, Bob Hasan, subsequently asked for approval on whether the bill would be agreed as an initiative proposal to be taken to the DPR’s plenary session.

“Next, once again, we ask for the approval of the members of Baleg, after hearing the views of the factions. Can the harmonisation result of the bill on the Second Amendment to Law Number 23 of 2006 concerning Population Administration be processed further in accordance with the prevailing laws and regulations?” he asked, to which the Baleg members agreed.
