A member of Commission X of the DPR RI, Habib Syarief Muhammad, has requested that the government provide affirmative policies for contract teachers in the selection process for Government Employees with Employment Agreements (PPPK). According to him, the implementation of bureaucratic reforms based on the ASN Law should not be done rigidly, potentially harming teachers who have long served in public schools.

“Amidst a significant shortage of teachers, the country faces a regulatory dilemma. If the elimination of contract teachers is carried out without a fair transition mechanism, not only the fate of the teachers but also the sustainability of national education is at risk. The lack of synchronisation between the Ministry of Education and Culture and the Ministry of Administrative and Bureaucratic Reform has created legal uncertainty that is unsettling,” said Habib Syarief in a statement on Friday (15/5).

He highlighted the issue of contract teachers, which has become increasingly prominent following the mandate of Law Number 20 of 2023 regarding the arrangement of non-ASN personnel, which must be completed by 2024.

On the other hand, Indonesia still faces a shortage of more than 480,000 teachers, while the number of retiring teachers reaches around 70,000 people each year. Currently, there are about 237,000 non-ASN teachers who still support teaching and learning activities in public schools in various regions.

He believes that ignoring contract teachers simply because of administrative issues is a step that does not reflect fairness. He emphasised that the law should side with the interests of people and the sustainability of education.

“Therefore, humanitarian aspects and the sustainability of education must be the top priority above bureaucratic procedures,” he said.

Therefore, Habib proposed special recognition for teachers who have served for five to ten years so that they are not treated the same as new applicants in the PPPK selection.

He also supports the implementation of a part-time PPPK scheme as a transitional solution so that contract teachers still have legal certainty after the deadline for the arrangement of non-ASN personnel is enforced.

In addition, Habib also asked the central government to ensure budget support for local governments to pay the salaries of PPPK teachers. He also proposed a moratorium on administrative sanctions for educational institutions that still employ non-ASN teachers as long as the national teaching staff needs have not been fully met.

“Ignoring the existence of contract teachers in the name of regulatory compliance is a failure of legal logic. We must not allow these education heroes to become victims of bureaucratic transitions. The law must act as an instrument of welfare and social protection, not just a rigid instrument of punishment,” he concluded. (H-3)
