DPR Legislation Body Monitors Constitutional Court Ruling on BPK's Authority in State Losses
The DPR’s Legislation Body will summon the BPK, BPKP, and the Supreme Court regarding the supervision and evaluation of the Corruption Criminal Act, particularly concerning the assessment of state losses.
Baleg Chairman Bob Hasan stated that this relates to Constitutional Court Ruling Number 28/PUU-XXIV/2026 on the authority to assess state losses.
The ruling specifies, among other things, that only the BPK is authorised to determine state losses.
“Baleg DPR in the upcoming session will hold a working meeting on the Supervision and Evaluation of the Corruption Criminal Act by inviting: BPK, BPKP, the Supreme Court, the Indonesian Institute of Accountants, and law enforcement parties,” said Bob in his statement on Tuesday (14/4).
The ruling also mentions that the MK requests DPR to make improvements and provide clarity on the norm or phrase “state losses”.
Furthermore, Deputy Chairman of Baleg DPR Martin Manurung said that the purpose of this review is to ensure there is no differing interpretation of the norm or phrase “state losses” by law enforcement.
“Because inconsistent application of the norm/phrase state losses has the potential to create legal uncertainty and injustice in law enforcement,” he emphasised.
Martin explained that this monitoring and review will provide space for the public and all interested parties to convey their aspirations to Baleg regarding the MK ruling.
