DPR Ethics Council Rules Adies Kadir's Constitutional Court Fitness Test Did Not Violate Ethics Code
The House of Representatives’ Ethics Council (MKD) has ruled that the fit and proper test process for Adies Kadir as a candidate justice of the Constitutional Court (MK) did not violate any ethical codes.
The MKD held a press conference regarding the alleged ethical violations in the fit and proper test of Adies conducted on 26 January. The previous hearing was held as a case without a formal complaint.
“Verdict: the MKD hereby decides and adjudicates as follows. First, no ethical violations were found in the fitness and propriety test process nor in the selection of Adies Kadir as a Constitutional Court justice candidate from the DPR element by Commission III of the DPR, which was ratified at a DPR plenary session,” said MKD Chairman Nazaruddin Dek Gam, reading out the verdict at the MKD hearing room in the parliamentary complex on Wednesday (18 February).
In his statement, Dek Gam continued, the MKD needed to examine the fit and proper test process for Adies because certain parties had questioned its legitimacy.
However, based on the MKD’s examination, Dek Gam said, the fit and proper test process had fulfilled all legislative requirements.
“Adies Kadir meets the requirements to serve as a Constitutional Court Justice as stipulated in Article 15 paragraph 2 of the Constitutional Court Law,” he said.
“Because the method and requirements for the selection of Adies Kadir as a Constitutional Court justice candidate nominated by the DPR are already in accordance with prevailing legislation, there is no violation of the DPR’s ethical code in the process,” Dek Gam added.
He affirmed that the process of designating Adies as a Constitutional Court justice candidate was in compliance with the MD3 Law and DPR Regulations governing rules of procedure and the code of ethics.
