Don't Rush to Judge, the Cipayung Tragedy Must Be Investigated Objectively

The death of three workers in a piping project in the Cipayung area is a tragedy that leaves deep sorrow. This incident must serve as a momentum to comprehensively evaluate the implementation of Occupational Safety and Health (K3) to prevent similar occurrences in the future. However, amidst the ongoing investigation, there have been calls for the Governor of DKI Jakarta to immediately dismiss the President Director of PAM Jaya. Such a step is questionable as it potentially pre-empts the official investigation results. In a state governed by law, every workplace accident has a clear handling mechanism. The determination of responsible parties must be based on facts, the results of law enforcement investigations, and examinations by labour inspectors, not on assumptions or public opinion pressure. The public also needs to view this issue holistically. Based on an explanation provided by the Commissioner of PAM Jaya to the public, the work on the ground was carried out by PT Moya Indonesia as the implementing contractor. Therefore, the investigation process should first unravel the entire chain of responsibility, from the work executor, the application of K3 standards, the supervisory system, to the contractual relationships of the parties involved. In construction projects, legal responsibility is not automatically borne by the project owner every time a workplace accident occurs. There is a division of responsibilities regulated in the work contract and statutory regulations. Thus, who was negligent, who controlled the work on site, and who is responsible for implementing K3 can only be determined through an objective and transparent investigation. If the work was still in the execution phase and had not yet been handed over to the project owner, this fact also becomes an important part that must be examined in the investigation process. All technical, administrative, and contractual aspects must be thoroughly disclosed so that no party is targeted before all facts are revealed. Criticism of project organisers is part of democracy. However, criticism must also be built on data and the ongoing legal process. Demands for the dismissal of PAM Jaya’s President Director before the investigation results are announced risk obscuring the substance of the problem, which is uncovering the cause of the accident and ensuring who is truly responsible. What the public needs now is not premature judgement, but a professional, independent, and transparent investigation. All parties with a role in the project, from the implementing contractor and supervisory consultant to other parties with legal responsibilities, must be examined proportionally. Only in this way can justice for the victims be upheld, while ensuring that a similar tragedy does not happen again. The Cipayung tragedy must not be used as a tool to build opinions that pre-empt the legal process. Respecting the investigation results is a form of respect for the principles of justice and good governance. Whoever is later proven negligent must be held accountable. But before the legal facts are revealed, no one deserves to be sentenced in the court of public opinion.
