Jakarta — The Directorate General (DG) of Immigration under the Ministry of Immigration and Correctional Services is monitoring the case of assault against a Brunei national in Blok M and ensuring that the perpetrator, who is also a foreign national, is prosecuted through both criminal justice and immigration administrative processes.

DG of Immigration Hendarsam Marantoko stated that every foreign national who violates the law in Indonesia will face consequences in accordance with applicable legal channels. No one escapes accountability.

“The case of assault against the Brunei national in Blok M is on our radar. The perpetrator has already been arrested by police. This is a general criminal offence, not an immigration offence. So the primary domain lies with the police,” said Hendarsam, confirmed in Jakarta on Tuesday.

Hendarsam explained that general criminal offences fall under the police’s jurisdiction, and Immigration does not precede the ongoing legal process.

According to him, Immigration is awaiting the legal process to conclude. Following that, Immigration will intervene with appropriate measures, either through criminal prosecution or administrative action including deportation of the perpetrator.

“If referred to us, what we can do is criminal prosecution, and also administrative action,” he said.

The normal mechanism, he stated, involves the criminal process, a verdict being passed, the sentence being served, and only then deportation being carried out.

However, if the police hold a different view, Immigration stands ready to adjust and ensure inter-institutional coordination continues.

“Immigration for the people does not mean being lenient towards perpetrators of crime,” Hendarsam emphasised.
