Director General to Staff at Manpower Ministry Sentenced to 4-6.5 Years in Prison for K3 Case
Seven officials and staff from the Ministry of Manpower (Kemenaker), ranging from a director general to a junior expert inspector, who were defendants in a bribery and gratuity case concerning the management of occupational health and safety (K3) certificates, were sentenced to between 4 and 6.5 years in prison on Thursday (4/6).
The panel of judges at the Corruption Court at the Central Jakarta District Court declared the defendants guilty of committing corruption together.
The judge stated that Defendant I, Hery Sutanto, and Defendant II, Subhan, were proven to have received gratuities amounting to Rp1.45 billion and Rp598.7 million respectively. “The Panel of Judges concluded that the total receipts can be declared as gratuities for Defendant I Hery Sutanto amounting to Rp1,455,120,000 and for Defendant II Subhan amounting to Rp598,722,222,” the judge said.
The judge stated that the total non-technical money received by the defendants was worth Rp49.6 billion.
In its verdict, the judge stated that this non-technical money was given by Occupational Safety and Health Service Companies (PJK3), which contravened the defendants’ obligations related to their public service positions. “Therefore, the panel of judges cannot solely base the determination of the amount of non-technical money received by each of the defendants merely on the figures stated in the public prosecutor’s demands, but rather on calculations based on legal facts from the trial,” the judge stated.
Furthermore, in its verdict, the panel of judges disagreed with the prosecutor’s demands regarding the receipt of honorarium fees by the defendants. The judge declared that these honorarium fees were lawful. “The receipt of honorariums as speakers or evaluators is a legally valid receipt for the defendants,” the judge said.
The judge declared Hery, Subhan and Fahrurozi guilty of violating Article 12 letter b and Article 12 letter B in conjunction with Article 18 of the Corruption Eradication Law in conjunction with Article 20 letter c in conjunction with Article 127 paragraph 1 of Law Number 1 of 2023 concerning the Criminal Code.
Meanwhile, Gery, Sekarsari, Anitasari and Supriadi were proven guilty of violating Article 12 letter b in conjunction with Article 18 of the Corruption Eradication Law in conjunction with Article 20 letter c in conjunction with Article 127 paragraph 1 of Law Number 1 of 2023 concerning the Criminal Code.
The complete sentences for the 7 defendants in this case are as follows:
Fahrurozi, Director General for Labour Inspection Development and K3 as of March 2025, sentenced to 4 years in prison, a fine of Rp200 million subsidiary to 90 days of confinement, and a restitution payment of Rp35 million subsidiary to 1 year of confinement.
Hery Sutanto, Director of Institutional Development from 2021 to February 2025, sentenced to 6.5 years in prison, a fine of Rp200 million subsidiary to 90 days of confinement, and a restitution payment of Rp7.59 billion subsidiary to 2 years of confinement.
Subhan, Sub-coordinator for Occupational Safety at the Directorate of K3 Development from 2020-2025, sentenced to 4.5 years in prison, a fine of Rp200 million subsidiary to 90 days of confinement, and a restitution payment of Rp1.94 billion subsidiary to 1 year of confinement.
Gerry Aditya Herwanto Putra, Coordinator for the Testing and Evaluation of Occupational Safety Competence in 2022, sentenced to 4.5 years in prison, a fine of Rp200 million subsidiary to 90 days of confinement, and a restitution payment of Rp828.5 million subsidiary to 1 year.
Sekarsari Kartika Putri, Sub-coordinator for K3 Institutional Development at the Directorate General of Labour Inspection Development and K3, sentenced to 4.5 years in prison, a fine of Rp200 million subsidiary to 90 days of confinement, and a restitution payment of Rp900 million subsidiary to 1 year of confinement.
Anitasari Kusumawati, Sub-coordinator for Partnership and Occupational Health Personnel in 2020, sentenced to 4.5 years in prison, a fine of Rp200 million subsidiary to 90 days of confinement, and a restitution payment of Rp1.35 billion subsidiary to 1 year of confinement.
Supriadi, Junior Expert Labour Inspector as Sub-coordinator for K3 Personnel Empowerment at the Directorate General of Labour Inspection Development and K3, sentenced to 4.5 years in prison, a fine of Rp200 million subsidiary to 90 days of confinement, and a restitution payment of Rp3 billion subsidiary to 1 year of confinement.
In a previous session, the panel of judges also handed down a guilty verdict and sentenced former Deputy Minister of Manpower Immanuel Ebenezer, also known as Noel, to 4 years and 6 months in prison and a fine of Rp200 million subsidiary to 90 days of confinement. In addition, the judge punished Noel with a restitution payment of Rp3.4 billion subsidiary to 1 year in prison. Following the reading of the verdict, Noel accepted the judge’s decision.
On the same day, the panel of judges also sentenced Irvian Bobby Mahendro, nicknamed the ‘Sultan’ of the Manpower Ministry, to six years in prison for the K3 certificate management bribery case. The judge declared Bobby guilty of receiving illicit non-technical money from PJK3. Furthermore, the judge punished Bobby with a fine of Rp200 million subsidiary to 90 days of confinement. Bobby was also sentenced to pay restitution of Rp36.04 billion subsidiary to 3 years of confinement. However, the judge stated that Bobby was not proven to have received gratuities. The panel of judges stated that the public prosecutor from the Corruption Eradication Commission (KPK) did not present valid, corroborating evidence with probative value to strengthen the argument for the receipt of said gratuities.
