Deputy Law Minister Confirms One of Three Criminal Code Implementing Regulations Issued

Deputy Minister of Law (Wamenkum) Edward Omar Syarief Hiariej (Eddy) has stated that one of the three Draft Government Regulations (RPP) mandated by Law Number 1 of 2023 concerning the National Criminal Code (KUHP) has been issued. The regulation in question pertains to ‘The Living Law’ and is formalised as Government Regulation (PP) Number 55 of 2025. The remaining two regulations, concerning criminal commutation and criminal procedure, are still under discussion.

Eddy made this statement during a working meeting with House of Representatives (DPR RI) Commission XIII, which was discussing the Ministry of Law’s budget absorption for the 2025 fiscal year. He was responding to a query regarding why the implementing regulations had not been issued three years after the National KUHP was enacted, despite a 100 per cent budget absorption rate.

He explained that the 25 mandates for implementing regulations are being consolidated into three main legal instruments. The presidential regulation related to an information technology-based criminal justice system is also being prepared. Eddy noted that the government regulation on the implementation of the Criminal Procedure Code (KUHAP) is still under discussion as it contains 253 articles and will replace Government Regulation Number 27 of 1983.

To address the legal vacuum, several law enforcement agencies, including the Attorney General’s Office, have issued internal regulations, such as those concerning supervisory punishment and social work. Eddy stated that these existing rules would be incorporated into the new government regulation to ensure legal harmony. He added that the draft regulation on the implementation of the KUHAP will also integrate Government Regulation Number 11 of 1974 and Government Regulation Number 43 of 1948 regarding the management of seized assets, following a recommendation from Commission XIII member Rieke Diah Pitaloka.
