Delpedro and Co-Defendants Acquitted; DPR Member Hopes Prosecutors Do Not Appeal

JAKARTA — Nasir Djamil, a member of Commission III of the DPR from the PKS faction, hopes that the public prosecutors will accept the acquittal of Delpedro Marhaen Rismansyah and his co-defendants in the case of alleged incitement during the August 2025 demonstration.

Nasir said that the panel of judges’ decision should not be followed by a challenge through an appeal or cassation.

“Our hope is that the public prosecutors will not file a cassation and will be able to accept the acquittal.”

Nasir emphasized that the acquittal for Delpedro and his co-defendants is something to be grateful for.

“We are grateful to the panel of judges who still possess conscience and judgement so that Delpedro and his colleagues were acquitted,” he said.

“This acquittal, in my view, is a victory for democracy and for civil liberties.”

Nevertheless, Nasir said the investigators’ and prosecutors’ beliefs in pursuing the case must still be respected.

“Nevertheless, the investigators and prosecutors hold beliefs that cannot be blamed. The investigators’ and prosecutors’ belief that Delpedro and his colleagues incited during the August 2025 demonstration has been overturned by the panel of judges. We respect those beliefs,” he concluded.

The panel declared that Delpedro Marhaen, Muzaffar Salim, Syahdan Husein, and Khariq Anhar were not proven beyond reasonable doubt to have incited the riot that followed the demonstration.

“Announcing that defendant I Delpedro Marhaen Rismansyah, defendant II Muzaffar Salim, defendant III Syahdan Husein and defendant IV Khariq Anhar were not proven beyond reasonable doubt to be guilty of the offences as charged in the first, second, third, and fourth counts,” said Chief Judge Harika Nova Yeri as she read the verdict at the Central Jakarta District Court, Kemayoran, on Friday 6 March 2026.

“The court therefore acquits the defendants of all charges brought by the Prosecution,” she added.

The panel also ordered that the four defendants be released from custody after the verdict was read.

The judge also urged that the defendants’ rights in terms of capacity, standing, and dignity be restored.

It should be noted that the public prosecutors had demanded two years’ imprisonment for Delpedro and the other three defendants.

In the indictment-reading at the Central Jakarta District Court on Friday 26 February 2026, the prosecutors stated that the four defendants were proven to have jointly incited others in public, verbally and in writing, to commit criminal acts or to oppose public authorities by force.

The prosecutors said the acts violated Article 246 in conjunction with Article 20C of Law No. 1 of 2023 on the Indonesian Criminal Code (KUHP).
