Defendants in Bank Branch Manager Murder Case Sentenced to One to 13 Years in Prison
The Military Court II-08 Jakarta, East Jakarta, has handed down prison sentences of one to 13 years to the defendants involved in the alleged kidnapping and murder of a bank branch manager, identified by the initials MIP (37).
“Considering that after examining and considering the aforementioned matters, the Panel of Judges is of the opinion that the punishment as stated in the dictum below is fair and balanced with the guilt of the defendants,” stated Chief Judge Colonel Chk Fredy Ferdian Isnartanto during the verdict reading at the Jakarta Military Court on Wednesday.
In the verdict, the panel of judges declared that the first defendant, Serka Mochamad Nasir, was sentenced to 13 years in prison after being found legally and convincingly guilty of the subsidiary charge of “jointly committing murder.”
The second defendant, Kopda Feri Herianto, was sentenced to seven years in prison after being found guilty of “jointly depriving a person of their liberty resulting in death.” Meanwhile, the third defendant, Serka Frengky Yaru, received a one-year prison sentence for the same charge of “jointly depriving a person of their liberty resulting in death.”
“The first and second defendants are also subject to the additional penalty of dishonourable discharge from military service,” said Fredy.
Previously, the prosecution had sought a 10-year prison sentence for Kopda Feri Herianto (minus time served) and a four-year sentence for Serka Frengky Yaru. Furthermore, the first and second defendants faced additional penalties including dismissal from the Indonesian Army (TNI AD).
Additionally, the defendants were ordered to pay restitution to the victim’s family amounting to Rp5.8 billion. This figure was determined following an in-depth investigation and loss assessment by the Witness and Victim Protection Agency (LPSK). The restitution claim was filed by the victim’s wife, Puspita Aulia, as the legal heir. The case involves allegations of premeditated murder and premeditated assault resulting in death involving three members of the Indonesian Army.
