Defendant in K3 Certification Extortion Case Faces Three-Year Prison Sentence
The defendant in the extortion case involving the processing of Occupational Health and Safety (K3) certificates, Miki Mahfud, has been sentenced to three years in prison. Miki is the husband of a primary expert auditor at the Corruption Eradication Commission (KPK).
“Sentencing the defendants, Temurila and Miki Mahfud, to three years of imprisonment each,” stated the prosecutor while reading the sentencing demand at the Central Jakarta Corruption Court on Monday (18/5/2026).
Miki is also required to pay a fine of Rp 250 million. Failure to pay the fine will result in an additional 90 days of imprisonment.
The aggravating factor in the sentencing was that the actions of both defendants were deemed to undermine government programmes aimed at achieving a clean administration free from collusion, corruption, and nepotism. Conversely, mitigating factors included their honesty in admitting their offences, their lack of prior criminal records, their family responsibilities, and their respectful conduct during the trial.
Prosecutors stated that Temurila and Miki were found guilty of violating Article 5, paragraph 1, point b of the Anti-Corruption Law in conjunction with Article 20, point c and Article 127, paragraph 1 of Law Number 1 of 2022 regarding the Criminal Code.
Previously, KPK prosecutors indicted the former Deputy Minister of Manpower, Immanuel Ebenezer Gerungan, also known as Noel, for orchestrating the extortion of K3 certification processing alongside several civil servants from the Ministry of Manpower. Prosecutors alleged that Noel demanded a total of Rp 3 billion.
The prosecution stated that Noel carried out these actions alongside other defendants, including Fahrurozi, Hery Sutanto, Subhan, Gerry Aditya Herwanto Putra, Irvian Bobby Mahendro, Sekarsari Kartika Putri, Anitasari Kusumawati, Supriadi, Miki Mahfud, and Temurila. The trial was held in separate proceedings at the Central Jakarta Corruption Court on Monday (19/1).
“Have acted unlawfully or abused their power regarding the issuance and extension of Individual Occupational Health and Safety (K3) Certifications/Licences for applicants,” the indictment against Noel stated.
In the indictment, prosecutors alleged that the defendants coerced K3 certification and licence applicants to provide funds totalling Rp 6,522,360,000 (approximately Rp 6.5 billion). These activities reportedly took place since 2021, prior to Noel’s appointment as Deputy Minister of Manpower.
