Defendant in bank branch manager murder case refuses to pay restitution
Jakarta (ANTARA) - The defendant in the case of alleged kidnapping and murder of a bank branch manager with the initials MIP (37), through his legal counsel (PH), refused to pay restitution as requested by the victim’s heirs.
In the proceedings, each defendant’s counsel stated that their clients were unable to pay restitution to the heirs of the victim for various reasons, namely lack of financial capability and denying direct involvement in the matter.
The first defendant, Serka Mochamad Nasir, through his legal adviser, Captain Zulham, stated that he is unable to fulfill the restitution demands filed by the victim’s family.
According to him, Defendant 1 does not have funds to pay the compensation.
“From Defendant 1, Defendant 1 cannot undertake to provide restitution because Defendant 1 does not have the funds,” Captain Zulham said during the session addressing the defendants’ responses to the restitution request at Military Court II-08 Jakarta, on Thursday.
The defence team also said that Serka Nasir merely carried out duties ordered by others in the case.
Therefore, according to them, the party who should be responsible for paying restitution is a witness named Dwi Hartono.
“In this matter, Defendant 1 only carried out the tasks given by witness 7. Thus, in this matter, the one more suitable to replace the restitution is witness 7 Dwi Hartono who had instructed to perform this work,” Zulham explained.
Meanwhile, the second defendant, Kopda Feri Herianto, also stated that he could not pay restitution to the victim’s family.
“Defendant 2 states that he does not undertake the costs of restitution to the heirs because he does not have funds and costs,” he said.
As for the third defendant, Serka Frengky Yaru, via his legal adviser, Lieutenant Colonel CHK Nugroho Muhammad Nur, stated that his client refuses the restitution claim because he feels not involved in the case, whether directly or indirectly.
“That the restitution costs proposed by the victim or heirs through LPSK is not undertaken by Defendant 3 because according to trial facts he is not involved, either directly or indirectly,” Nugroho said.
The defendant in the case of kidnapping and murder of the bank branch head with initials MIP (37) is accused of paying restitution to the victim’s family amounting to Rp5.8 billion.
“LPSK has conducted in-depth checks and assessment of the loss magnitude suffered by the victim or his heirs from the criminal incident, with the applicant’s loss value at Rp5,851,192,240,” said Military Prosecutor from the Military Registry II-07 Jakarta Major Chk Wasinton Marpaung in a continued hearing at the Military Court II-08 Jakarta, on Thursday.
Wasinton revealed that the official restitution request documents were only received by him from the Lembaga Perlindungan Saksi dan Korban (LPSK) after the charges were read in the proceedings last week.
