Deemed Provocative, Ade Armando and Permadi Arya Reported to Police
Jakarta (ANTARA) - The Aliansi Profesi Advokat Maluku (APAM) reported two social media activists, Ade Armando and Permadi Arya, to the Metro Jaya Regional Police in South Jakarta on Monday (20/4) for allegedly committing incitement and provocation.
“Today, we visited the Metro Jaya Regional Police to file a police report regarding the alleged criminal acts of incitement and provocation purportedly carried out by Mr Ade Armando and Permadi Arya via social media,” said APAM representative and complainant, Paman Nurlette, when met at the Criminal Investigation Unit of the Metro Jaya Regional Police on Monday.
Paman explained that according to Article 1 paragraph 3 of the 1945 Constitution of the Republic of Indonesia, Indonesia is a state based on law, which implies that all issues should be processed through the applicable legal channels.
“Therefore, as law-abiding citizens with ethical awareness, we have come to report Mr Ade Armando and Permadi Arya, in the hope that they will be processed through the proper legal mechanisms to provide justice that is certain, certainty that is just, and benefits for all Indonesian people,” he stated.
Paman said the report was filed because excerpts from a sermon by Mr Jusuf Kalla at the UGM Campus Mosque pulpit, which were edited and then distributed or transmitted by Mr Ade Armando via the Cokro TV YouTube channel and Permadi Arya’s Facebook account, have caused real uproar and disturbance in the public sphere and society.
“This has ignited negative views, hatred, and enmity from certain religious communities to attack the honour and dignity of Mr Jusuf Kalla, and they have even joined in attacking Islam, the Quran, and Prophet Muhammad, peace be upon him,” he said.
He also believes that if the video had been uploaded in its complete form, without being edited as it is now, society would not have been contaminated, and people would not have been provoked by such a video.
Paman further emphasised that, in this context, the viral video allegedly shared by Ade Armando and then Permadi Arya already fulfils the elements of malicious intent or mens rea.
“So if they had publicised it in full, the video would automatically be understood comprehensively, without losing the substantive meaning of the sermon, but because it was edited, it has caused a commotion,” he said.
Paman also conveyed that anyone who intentionally, without rights, distributes or transmits electronic information or electronic documents that incite, influence, or encourage others to engender feelings of hatred and enmity towards individuals or certain social groups based on race, ethnicity, skin colour, religion, and disability can be punished.
The report itself has been received by the Criminal Investigation Unit with number STTLP/B/2767/IV/2026/SPKT/POLDA METRO JAYA, with the reported articles being Criminal Acts of Electronic Information and Transactions under Law No. 1/2024 on the Second Amendment to Law No. 11/2008 on Electronic Information and Transactions as per Article 48 of Law 1/2024 juncto Article 32 and/or Article 243 of the Criminal Code.
He also brought evidence including the complete, comprehensive version of Jusuf Kalla’s video, the edited video excerpt from Ade Armando on Cokro TV, the edited video excerpt from Permadi Arya on his Facebook account, accompanied by comments from netizens who commented on those two accounts attacking Islam, the Quran, and Prophet Muhammad.
