Dasco: House of Representatives Drafting Academic Paper for Asset Forfeiture Bill

Deputy Speaker of the House of Representatives Sufmi Dasco Ahmad has said that Commission III is currently drafting the academic paper for the Bill on Asset Forfeiture Related to Suspected Criminal Offences. The Gerindra Party daily chairman stated that the House had begun drafting the Asset Forfeiture Bill after ratifying the revision of the Criminal Procedure Code (KUHAP).

“Commission III of the House of Representatives is currently conducting problem analysis and is in the process of drafting the academic paper and the bill,” Dasco told reporters in a video received by Tempo on Tuesday evening, 23 February 2026.

The House’s legal affairs commission began discussing the drafting of the academic paper and the Asset Forfeiture Bill on Thursday, 15 January 2026. The discussion commenced after the House’s Expert Body completed its preparatory report, which had been underway since November 2024.

The preliminary Asset Forfeiture Bill drafted by the House’s Expert Body comprises 8 chapters and 62 articles. The draft covers general provisions, scope, criminal assets subject to forfeiture, procedural law for asset forfeiture, international cooperation, funding, and closing provisions.

The House’s Expert Body considers the Asset Forfeiture Bill to be of urgent importance, requiring prompt deliberation and enactment into law. In the sociological basis set out in the academic paper, the Expert Body noted that the rate of state loss recovery remains low.

At the same time, there has been an increase in economically motivated criminal offences, which is deemed to have damaged the national economic order. The Criminal Asset Forfeiture Bill was originally proposed by the Financial Transaction Reports and Analysis Centre (PPATK) in 2008. Over the years, the bill was included in the priority national legislation programme in 2023 and is now part of the 2025-2026 priority national legislation programme.

Vice President Gibran Rakabuming Raka recently stated that the government fully supports the eradication of corruption through the ratification of the bill. He called for the deliberation of the Asset Forfeiture Bill to be conducted seriously, comprehensively, participatively, and transparently. According to Gibran, the resulting legal framework should be sharp against corrupt officials but not arbitrary towards the innocent.

He acknowledged understanding the concerns surrounding the implementation of such a legal framework. “Such as violations of the presumption of innocence principle and the potential for abuse of authority. These concerns are understandable,” said Gibran in a video statement uploaded to his official Instagram account @gibran_rakabuming on Friday, 13 February 2026.
