Court Orders Execution of Land Dispute Ruling Against PT Obsidian Stainless Steel in Southeast Sulawesi

KENDARI – The legal counsel for Ainin Indarsih and siblings, Andre Darmawan, has filed a request for execution of a land dispute ruling against PT Obsidian Stainless Steel (PT OSS) with the Unaaha District Court, in accordance with the appellate decision handed down by the Southeast Sulawesi High Court.

"The filing for continued land execution, which had been delayed due to opposition efforts by PT OSS, was submitted on 1 July 2025," said Andre Darmawan in a statement on Monday (7/7/2025).

Ainin Indarsih and siblings won their appeal against PT OSS's opposition filed at the Unaaha District Court, following their earlier victory in a case against PT Virtu Dragon Nickel Industry (VDNI) at the same court.

The dispute arose because PT OSS had purchased a 400×400 plot of land from PT VDNI whilst the latter was still engaged in legal proceedings at the Unaaha District Court, as filed by Ainin Indarsih and siblings.

PT OSS initially won its opposition claim, prompting the legal counsel for Ainin Indarsih and siblings to file an appeal. The Southeast Sulawesi High Court subsequently granted the appeal, overturning Unaaha District Court Decision No. 22/Pdt.Bth/2024/PN Unh, which had ruled in favour of PT OSS's opposition.

Accordingly, based on Southeast Sulawesi High Court Decision No. 21/Pdt/2025/PT KDI, which rejected the opposition from PT OSS, the legal counsel has filed for execution based on Execution Order No. 2/Pdt.Eks/2024/PN Unh Jo.11/PDT/2024/PT KDI Jo.22/Pdt.G.2023/PN Unh, so that the land execution process may resume in order to deliver justice and legal certainty to the applicant.

"We hope the District Court will promptly proceed with the execution to provide justice and legal certainty for our client. PT OSS should not appear to be stalling for time, as this is an immediately enforceable ruling, meaning it can be carried out regardless of any opposition, appeal or cassation," he added.
