Corruption Case: KPK Prosecutor Charges Former HSU District Prosecutor with Cumulative Articles
Banjarmasin - The public prosecutors (JPU) from the Corruption Eradication Commission (KPK) have charged former Head of the Hulu Sungai Utara District Prosecutor’s Office (Kajari HSU) Albertinus Parlinggoman Napitupulu with cumulative articles during the first trial session, which featured the reading of the indictment, at the Banjarmasin District Court. “The defendant Albertinus Parlinggoman Napitupulu is charged cumulatively,” stated KPK Public Prosecutor Muhammad Hadi during the trial on Tuesday. He explained that the first charge against Albertinus relates to Article 12 letter e in conjunction with Article 18 of Law No. 31 of 1999 on the Eradication of Criminal Acts of Corruption as amended by Law No. 20 of 2001 in conjunction with Article 127 paragraph 1 of the Criminal Code. The second charge is under Article 12 letter f in conjunction with Article 18 of the Anti-Corruption Law in conjunction with Article 127 paragraph 1 of the Criminal Code. Meanwhile, the third charge relates to Article 12 letter B in conjunction with Article 18 of the Anti-Corruption Law in conjunction with Article 127 paragraph 1 of the Criminal Code. The defendants, former HSU Prosecutor’s Office Intelligence Section Head Asis Budianto and former Prosecution Section Head Tri Taruna Fariadi, are also charged cumulatively. Their first charge matches Albertinus under Article 12 e, while the second is under Article 12 letter B in conjunction with Article 18 of the Anti-Corruption Law in conjunction with Article 127 paragraph 1 of the Criminal Code. During the trial, only defendant Tri Taruna filed an objection or exception to the prosecutor’s indictment. Albertinus and Asis did not file any objections. The KPK public prosecutor also revealed the alleged gratification amounts listed in the indictment. For the first charge under Article 12 letter e, related to extortion in office involving subordinates, the amount is said to reach Rp894 million and involves all three defendants. The second charge under Article 12 letter f, related to direct extortion, only implicates Albertinus, with the alleged received amount reaching Rp257.5 million. Meanwhile, the third charge related to gratifications is recorded at Rp822.8 million. In addition, the KPK has prepared dozens of witnesses to uncover the case during the trial. After the reading of the indictment, the Chief Judge of the Panel, Aries Dedi, closed the session and scheduled the next agenda for Thursday (21/5). Previously, the three suspects were caught in a KPK hand arrest operation (OTT) in the extortion case against several officials and parties in the HSU Regency Government on 18 December 2023.
