Convicted of Land Corruption: Former Pertamina Chief Luhur Budi Djatmiko Sentenced to 18 Months

Jakarta (ANTARA) – Luhur Budi Djatmiko, former Director General of PT Pertamina (Persero) for the period 2012–2014, has been sentenced to one year and six months in prison after being found guilty of corruption in the land acquisition case in the Kuningan area, South Jakarta, by Pertamina between 2012 and 2014. Presiding Judge Brelly Yuniar Dien stated that Luhur Budi had acted unlawfully by submitting a budget allocation for the procurement of land for the construction of the Pertamina Energy Tower (PET) building during the discussion of the revised Work Plan and Company Budget (RKAP) of Pertamina for the 2013 fiscal year on 5 November 2012, without supporting investment studies. “The defendant has been proven guilty beyond reasonable doubt of committing the crime of corruption in concert with others, as stipulated in the subsidiary indictment,” said the Presiding Judge during the sentencing hearing at the Corruption Court at the Central Jakarta District Court on Tuesday. As a result of his actions, Luhur Budi caused a loss of Rp348.69 billion to the state’s finances, enriching the corporations PT Bakrie Swastika Utama and PT Superwish Perkasa by that amount. In addition to imprisonment, Luhur Budi was also sentenced to a fine of Rp500 million, with the provision that if the fine is not paid, it will be replaced (subsidiary) with a prison sentence of 5 months. For his actions, Luhur was found guilty of violating Article 3 in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption, as amended and supplemented by Law Number 20 of 2001 in conjunction with Article 55 paragraph (1) sub-1 of the Criminal Code. The panel of judges considered that Luhur Budi’s actions had become an obstacle to the government’s efforts to prevent and eradicate criminal acts of corruption and could reduce public trust in Pertamina and the government, which were considered as aggravating circumstances in the sentencing. Meanwhile, Luhur Budi, who had not committed any criminal acts before this, had served the country for a considerable time, his age of 70 years is considered advanced, and the defendant’s health condition were considered as mitigating circumstances. “After considering the aggravating and mitigating circumstances, the sentence imposed on the defendant has been appropriate, fair, and in accordance with the defendant’s guilt,” said the Presiding Judge. The sentence handed down by the judge was lighter than the demand of the public prosecutor (JPU). In its demand, the JPU requested that Luhur Budi be sentenced to 5 years in prison, a fine of Rp750 million with a subsidiary of 165 days in prison, and compensation of Rp348.69 billion with a subsidiary of 6 months in prison.
