Constitutional Court Ruling States Jakarta Remains the Nation's Capital; Anies Baswedan Responds
Jakarta, VIVA – Former Governor of Jakarta, Anies Baswedan, has commented on the Constitutional Court’s (MK) decision stating that Jakarta remains the nation’s capital.
Anies explained that the decision was not a surprise. He stated that the decision aligns with the applicable laws.
“As far as I know, there is nothing new, is there? Because the law is already like that. So, there is nothing new in the MK’s decision,” Anies said to reporters in South Jakarta on Saturday, May 16, 2026.
Regarding the relocation of the capital to the Nusantara Capital (IKN) in East Kalimantan, Anies said that this was a presidential decision.
Even though the construction and discourse on the relocation of the capital from Jakarta to IKN is still ongoing.
“But all of that is waiting for the President’s decision,” Anies said.
Previously, it was reported that the Constitutional Court (MK) rejected the judicial review of Law Number 3 of 2022 concerning the Capital City (UU IKN) and affirmed that the status of the Special Region of Jakarta (DKJ) remains as the nation’s capital.
In the consideration of the MK, read by Constitutional Judge Adies Kadir, as seen in the video of the announcement of the decision of case number 71/PUU-XXIV/2026 in Jakarta, Wednesday (13/5), it was stated that the petitioner’s argument stating that the norm of Article 39 paragraph (1) of Law Number 3/2022 is in conflict with Article 1 paragraph (3) and Article 28D paragraph (1) of the 1945 Constitution is conditionally accepted, as long as it is interpreted in accordance with the petitioner’s formulation, namely:
“As long as a presidential decision regarding the relocation of the capital city has not been established, Jakarta will remain the capital city of the Republic of Indonesia in order to guarantee the certainty and continuity of the state structure.”
