Constitutional Court Hears Government's Assurance on Personal Data Protection Agency Formation

The Indonesian government and the House of Representatives (DPR) have confirmed that the process of establishing the Personal Data Protection (PDP) Agency is still ongoing. The statement was made during a Constitutional Court (MK) hearing on Tuesday, 28 July 2026, addressing a judicial review of Article 58 paragraph (5) and Article 61 of the PDP Law. DPR Commission I member Nasir Jamil, representing the DPR, explained that the PDP Law mandates the formation of the agency and that the government is currently finalising the necessary derivative regulations. He stated that the absence of an explicit deadline for the agency’s formation does not create a legal vacuum. Alexander Sabar, Director General of Digital Space Supervision at the Ministry of Communication and Digital Affairs, confirmed that a draft Presidential Regulation for the agency has been submitted for approval. He assured the court that data protection oversight functions are currently being carried out by his directorate general. The petitioners, a group of advocates and students, had requested that the court declare the relevant articles conditionally unconstitutional and impose a two-year deadline for the government to establish the agency.
