Constitutional Court Affirms Jakarta Remains the Capital, DPR Commission II Responds
Member of DPR Commission II, Romy Soekarno, has proposed that the Presidential Palace in the Nusantara Capital (IKN) should begin to be utilised in the same manner as the Presidential Palaces outside the capital Jakarta.
This proposal was put forward by Romy in response to the Constitutional Court’s (MK) decision affirming that Indonesia’s capital remains in Jakarta until a Presidential Decree is issued.
However, while awaiting full readiness, according to Romy, the Presidential Palace in IKN should be usable.
“If necessary, the position of the State Palace in the Nusantara Capital can first be functioned at the level of a presidential palace area like the Bogor Palace, Cipanas Palace, or Tampaksiring Palace, while waiting for full readiness for the national government’s relocation,” said Romy in his statement on Wednesday (13/5).
He added that the MK’s decision, besides affirming that the state capital is still in Jakarta, also provides room for the government to prepare the national transition process gradually.
However, he said, the public need not worry and should not assume that the IKN construction process will be halted. Romy stated that construction in IKN will continue, but with a more realistic and measured approach.
“Do not interpret it as if the Nusantara Capital construction has stopped. Construction can still proceed, but the approach must be more realistic, gradual, measured, and strategic according to the state’s capabilities and national priorities,” said the PDIP politician.
He believes that IKN has great potential to become a modern government centre based on the environment, a national energy transition centre, a food security strengthening centre, and a centre for sustainable natural resource management.
On the other hand, he assessed that the relocation of ministries does not have to be done simultaneously. He said the government could prioritise ministries that are relevant to the environmental and energy development concept first.
Some of the ministries in question are the Ministry of Forestry, Ministry of Energy and Mineral Resources, Ministry of Environment and Forestry, or Ministry of Agriculture.
“Kalimantan has a strategic position in forestry issues, energy, mining, biodiversity, environmental living, and national food security,” he said.
Previously, the MK affirmed that DKI Jakarta Province is still Indonesia’s Capital when reading the decision on the material review application of Law Number 3 of 2022 concerning the State Capital (IKN).
The MK rejected the application registered under Number 71/PUU-XXIV/2026, which was read by MK Chief Justice Suhartoyo on Tuesday (12/5).
In that lawsuit, the petitioners assessed that the norm in Article 2 paragraph (1) of Law 2/2024 on the Special Region of Jakarta Province is not in sync with the norm in Article 39 paragraph (1) of Law 3/2022, thus creating a constitutional vacuum in the status of the state capital, which implies the validity of government actions, including the issuance of state administration decisions, state administration activities, and the implementation of government administration.
