Constitutional challenge to Article 603 of Criminal Code on BPK's state financial loss determination withdrawn
JAKARTA (ANTARA) — A constitutional challenge to Article 603 of the 2023 Criminal Code concerning BPK’s authority to determine state financial loss has been withdrawn, Constitutional Court Chief Justice Suhartoyo announced during a hearing on Tuesday.
The case, numbered 107/PUU-XXIV/2026, had sparked controversy over the State Audit Board’s role. Suhartoyo stated the court received a withdrawal letter from the applicants before proceeding with scheduled statements from the Supreme Court and BPK.
Lawyer Ranto Sibarani explained the applicants’ reasons: first, the new Criminal Code’s Article 603 is still in transition, requiring time for government and House of Representatives (DPR) to harmonise subordinate regulations; second, the challenge could cause widespread confusion in corruption law enforcement; third, prioritising other pending cases for efficiency.
The court had initially summoned relevant parties, including the Supreme Court, Corruption Eradication Commission (KPK), National Police (Polri), Financial and Development Supervisory Agency (BPKP), and Attorney General’s Office, due to the case’s significant implications. Suhartoyo confirmed the withdrawal means the court has no basis to proceed, with BPK and Supreme Court statements temporarily on hold pending the court’s decision on the withdrawal request.
