Commission III of the House of Representatives States Prabowo Urged Prevention of Judicial Errors
Jakarta (ANTARA) – The Chair of Commission III of the House of Representatives, Habiburokhman, has stated that President Prabowo Subianto has urged the commission to prevent errors in the judicial process or miscarriage of justice.
According to him, the President wishes to ensure that ordinary citizens who are parties to legal cases can smile because they have received justice.
“Specifically, President Prabowo Subianto has entrusted us with the message to avoid errors in the judicial process or miscarriage of justice,” said Habiburokhman at the parliamentary complex in Jakarta on Monday.
He conveyed this in response to a case involving a theft victim who became a suspect in defamation proceedings.
According to him, law enforcement authorities must exercise greater care in investigating defamation cases or those related to speech. If such cases arise, authorities must adhere to Article 36 of the Criminal Code (KUHP), he said.
The article stipulates that no person can be prosecuted or held accountable without the element of intentionality.
“No one can be held criminally responsible without the fulfilment of an undeniable element of intentionality,” he stated.
With the implementation of the new Criminal Code and Code of Criminal Procedure, he said that authorities should undergo a drastic paradigm shift in legal practice. This is because the new legislation emphasises rehabilitation, restoration, and substantive justice, rather than merely formalistic approaches.
“Commission III of the House of Representatives, as the body that discussed and ratified the new Criminal Code and Code of Criminal Procedure, is committed to ensuring that these two great legislative achievements can be truly implemented from their spirit, principles, to their legal norms,” he said.
