Commission III: Nabilah O'Brien No Longer Suspect Status

The head of the House of Representatives’ Commission III, Habiburokhman, has stated that the mutual reporting dispute between Bibi Kelinci Kopitiam Kemang restaurant owner Nabilah O’Brien and her customers has been resolved amicably. He noted that the Indonesian National Police has withdrawn the suspect status from Nabilah, who had previously been accused of defaming a married couple, Zendhy Kusuma and Evi Santi.

The Gerindra Party politician stated that the police have issued a discontinuation of investigation order (SP3) to conclude Nabilah’s case, which had undergone mediation with Zendhy. This information was conveyed during a public hearing held by Commission III of the House of Representatives with Nabilah and her legal representative at Parliament.

“The report against Nabilah O’Brien has been withdrawn and by extension, Nabilah O’Brien is no longer a suspect and this matter has been concluded,” Habiburokhman stated at Parliament in Jakarta on Monday, 9 March 2026.

According to Habiburokhman, Commission III of the House has actively monitored the handling of this case in recent days after Nabilah sought assistance from the legal affairs commission through social media. Based on Commission III’s assessment, it recommended that the police halt the legal process against Nabilah. The application of defamation provisions under the Information and Electronic Transactions Law against Nabilah was deemed inappropriate.

He assessed that Nabilah had no malicious intent when uploading CCTV footage from her restaurant showing Zendhy Kusuma and Evi Santi taking food without payment. Habiburokhman characterised Nabilah’s actions as those of a victim seeking redress for her losses.

He urged police to refer to Article 36 of the new Criminal Code (KUHP), which stipulates that no one can be held criminally liable without fulfilling the element of intent. Based on this, Habiburokhman stated that Nabilah’s actions did not meet the element of intent to defame or damage another person’s reputation. Therefore, Commission III supported the withdrawal of suspect status and advocated for the application of restorative justice.

“Not all legal disputes in society must be resolved through the courts. Minor legal disputes in society should as much as possible be resolved in a family manner outside the court system,” he said.

The Head of the National Police Public Information Bureau, Brigadier General Trunoyudo Wisnu Andiko, stated that both parties have formally withdrawn their police reports. In addition to withdrawing the reports, Nabilah, Zendhy, and Evi also agreed to delete posts on their social media accounts related to this case. However, Trunoyudo declined to explain the legal status of the three parties.

Nabilah and Zendhy became suspects because they had filed mutual police reports. Trunoyudo only stated that the withdrawal of reports could provide a sense of justice for both parties.
