Citing Indra Kenz, Law Students Propose Online Gambling Included in Asset Forfeiture Bill
The National Leadership Council of the Indonesian Law Students Association (DPN Permahi) has proposed that online gambling be included as a criminal cluster within the Asset Forfeiture Bill.
Permahi attended the follow-up public hearing (RDPU) regarding the Asset Forfeiture Bill at Commission III of the House of Representatives (DPR) on Wednesday (30/9).
“However, what we wish to add as the 14th cluster is related to the crime of gambling,” said Lalu Reno, representing DPN Permahi, during the meeting.
Reno highlighted the case of social media celebrity Indra Kenz, who was previously involved in a binary option investment fraud case. He questioned whether assets hidden in the form of cryptocurrency could also be seized.
“We all know that currently, there is heated discussion regarding the Cibinong Prison, where Indra Kenz has been granted parole. When Indra Kenz is sentenced, can assets hidden in the form of cryptocurrency be confiscated by the state?” Reno asked.
“Can assets hidden in cryptocurrency be seized by the state? We are not yet able to provide a legal answer to such a phenomenon,” he added.
Meanwhile, another representative from DPN Permaral, Hasbulah, questioned the seizure mechanism for assets that are only discovered after a perpetrator has served their prison sentence.
Consequently, he proposed that asset forfeiture should not only be conducted through a criminal approach but also through a civil approach.
“It should not be too sudden, as the approach is always criminal because it relates to corruption crimes. I believe the approach could also be through civil law,” he said.
