China, Australia, Canada Also Exempted from New DHE Rules, Not Just the US

Coordinating Minister for Economic Affairs Airlangga Hartarto has revealed that the government has added several export destination countries to the list of those exempted from the new Natural Resource Export Earnings (DHE) regulations. The countries now exempted include China, the United States, Australia, and Canada. The updated regulation, which came into effect on 1 June 2026, was the result of a limited coordination meeting held at the Coordinating Ministry for Economic Affairs. Previously, the exemption list in Government Regulation Number 21 of 2026 only included the United States. Under the new rules, 100% of natural resource DHE must be placed in state-owned banks (Himbara), with a mandatory retention of 30% of the earnings for three months for the oil and gas sector, and 100% for twelve months for the non-oil and gas sector in special accounts. However, the government has provided flexibility for exporters from countries that are Indonesia’s trading partners under bilateral or free trade agreements. This means natural resource exporters from the mining sector originating from countries that have an FTA with Indonesia are permitted to place a portion of their DHE retention outside of Himbara banks. Under this provision, exporters from partner countries can place 30% of their retention for a minimum period of three months in non-Himbara banks. Despite this relaxation, the government maintains the full repatriation obligation, requiring all natural resource exporters to bring 100% of their DHE into the domestic financial system. Non-oil and gas exporters are required to place 100% of their DHE retention in special accounts domestically for at least twelve months, while oil and gas exporters must place a minimum of 30% for at least three months.
