Centralised Criminal Justice System Being Built at the Supreme Court, Can It Control Law Enforcement?
JAKARTA, KOMPAS.com – The government is building a technology information-based criminal justice system that is integrated and centralised at the Supreme Court (MA).
The development of this centralised information system is mandated by the new Criminal Procedure Code (KUHAP).
In the future, the information system will no longer be designed to be dispersed across each law enforcement institution, but will instead be centralised at the MA.
Even the implementing regulations have already been placed on the President’s desk.
“There are two implementing regulations already on the President’s desk: one is the government regulation (PP) regarding the mechanism of restorative justice, and the second is the technology information-based criminal justice system, a Presidential Regulation (Perpres),” said Eddy during the 71st anniversary commemoration of the Indonesian Judges Association (IKAHI) at the MA Building on Tuesday (21/4/2026).
“And our agreement in the team (KUHP drafters) is that the technology information-based criminal justice system is placed at the Supreme Court. So everything is centralised at the Supreme Court,” said the Deputy Minister of Law and Human Rights.
In previous discussions, the system was once designed to be under the coordination of the Coordinating Ministry for Political, Legal, and Security Affairs.
However, there was a change in nomenclature at the coordinating ministry level.
Legal affairs were separated from the Coordinating Ministry for Political, Legal, and Security Affairs and are now under the Coordinating Ministry for Law, Human Rights, Immigration, and Corrections, led by Yusril Ihza Mahendra.
“That was an agreement from the Prosecutor’s Office colleagues and the Police colleagues because in the old draft, it was under the Coordinating Minister for Political, Legal, and Security Affairs. Then we thought, with apologies, the Coordinating Minister for Political, Legal, and Security Affairs does not oversee law enforcement,” said Eddy.
“Finally, after consultation with Prof Yusril, we agreed to place it at the Supreme Court, so it can control more broadly all law enforcement apparatus with the technology information-based justice system,” he stated.
In addition to the technology system, the government is also still completing other homework, namely the implementing rules for the new Criminal Procedure Code (KUHAP).
