Case of a Contract Teacher in Probolinggo Resolved Through Restorative Justice

The case of a contract teacher at SDN Brabe 1, Maron District, Probolinggo, Mohammad Hisabul Huda, has been resolved through restorative justice. Huda was initially named a suspect for holding positions as both a teacher and a village official.

“Currently, the investigation into this case has been halted,” said the Head of the Legal Information Centre at the Attorney General’s Office, Anang Supriatna, in Jakarta, Wednesday (25/2).

Anang stated that the Attorney General’s Office had been monitoring Huda’s case. According to Anang, based on the investigation, Huda was unaware that holding positions as both a teacher and a village official was prohibited.

Both positions were paid using the Regional Budget (APBD). According to existing regulations, an individual is not allowed to receive a salary from the same budget source more than once.

This case was also halted because Huda returned Rp118 million to the East Java High Prosecutor’s Office. This amount was calculated as the excess salary from the positions he held concurrently.

“Specifically, regarding village funds and the accompanying facilitators, holding dual positions is not allowed, especially when one of the positions receives funding from the APBD or APBN,” said Anang.

Anang stated that the Prosecutor’s Office believes that Huda was simply unaware of the prohibition on receiving salaries from the same source. The investigation revealed that Huda was only looking for additional income to meet his daily needs.

“He simply didn’t know; he was just looking for a side job,” said Anang. (Can/P-3)
