Capital Investment Draft Bill Pro-Foreign Investors

TEMPO Interactive, Jakarta: The government has confirmed that the Draft Bill on Capital Investment, which the Trade and Industry Commission of the House of Representatives (DPR) has approved, does not differentiate between local and foreign investors.

“Indonesia does not differentiate between local and foreign investors. This would not speed up capital investment and efforts to increase domestic capital investment,” said Industry Minister Fahmi Idris yesterday (03/27).

He acknowledged that the Capital Investment Draft Bill could not indeed remove the image of slanted towards foreign investors.

“In the past, between 1967 and 1968, we treated foreign investors differently to local investors. Now, the world has no boundaries, there is no difference between local or foreign capital,” said Fahmi.

The pro-foreign investors’ image, according to Fahmi, has also emerged since the Capital Investment Draft Bill did not mention about the resolution of disputes between foreign investors and the government.

“This is referred as being pro-foreign investors. In fact, the resolution has been stipulated in the law.” he said, adding that the resolution was not attached to the draft bill.

Fahmi said that the government would still carry out the required legal process should there be foreign investors who commit violations.

“These can still be processed and sued as long as there is a law that they violate,” he said.
