BPJS Kesehatan Inpatient Rules Under Scrutiny: JKN Participants' Rights When Wards Are Full

Inpatient services for BPJS Kesehatan participants have recently come under public scrutiny after a complaint emerged from a patient who claimed they had not received a treatment room despite waiting for eight hours at a hospital. The post sparked widespread discussion on social media, particularly after several comments from doctors and healthcare workers were deemed to lack empathy for the patient’s condition.

In response, BPJS Kesehatan provided clarification regarding the inpatient service provisions for participants of the National Health Insurance (JKN) programme. The explanation also affirmed participants’ rights when an inpatient room matching their membership class is unavailable.

Head of Public Relations at BPJS Kesehatan, Rizzky Anugerah, stated that hospitals, as healthcare facilities partnering with BPJS Kesehatan, are obliged to provide services in accordance with the service standards and regulations set by the government. He said healthcare services must be delivered easily, quickly, equitably, and without discrimination to all patients, including JKN participants. Thus, every participant retains the right to receive healthcare services according to the applicable provisions.

Rizzky explained that in practice, hospitals also have a bed management mechanism adjusted to the available service capacity and considering the medical condition of each patient. However, a shortage of inpatient rooms does not eliminate the right of JKN participants to obtain healthcare services according to medical indications. The hospital must still provide a solution in accordance with the prevailing rules if the treatment room corresponding to the participant’s entitlement is full.

He stressed that healthcare services for JKN participants must continue to refer to the provisions regulated by the government, so that patients do not lose their rights merely due to limited bed capacity.

BPJS Kesehatan reminded that the provisions regarding patient placement are regulated in the Minister of Health Regulation Number 28 of 2014 concerning Guidelines for the Implementation of the National Health Insurance Programme. The regulation explains that if an inpatient room matching the participant’s entitlement is not available, the hospital is permitted to place the patient in an inpatient room one level higher than their class entitlement.
