Bogor Regency Administration Prepares to Implement Bandung Administrative Court Ruling

In response to reports alleging that Bogor Regent Rudy Susmanto is defying the law by failing to implement the Administrative Court (PTUN) ruling, the Bogor Regency Government, through its Legal Cooperation and Assistance Section acting as the regent’s legal representative, has stated that such information is inaccurate and requires clarification.

The ruling in question is the Bandung PTUN Decision No. 51/G/TF/2022/PTUN.BDG dated 15 November 2022 in the dispute involving Herman Boenardy et al. against the Bogor Regent and PT Sentul City Tbk, which has attained final and binding legal force.

The operative part of the ruling sought for execution requires the Bogor Regent, as the defendant, to take administrative actions in the form of managing PSU specifically on the Taman Victoria site plan, for which Certificate of Right to Use No. 38 has been issued in the name of the Bogor Regency Government covering an area of 34,160 square metres.

Additionally, the ruling directs the Bogor Regent to provide guidance and supervision over the handover of PSU in the Sentul City Housing Estate in Bogor Regency, particularly on the Bukit Golf Hijau, Mediterania 1, Mediterania 2, Bukit Hijau, New Hiltop, Green Valley, Mediterania Golf Hill, Taman Venesia, and Taman Pasadena site plans.

Furthermore, guidance and supervision are also to be carried out on the Taman Sakura, Sierra Madre, Casablanca, Taman Andalusia, Taman Equator, Alpensia, Taman Legian, Taman Tampaksiring, Taman Besakih, Taman Udayana, Country Wood, England Park, Taman Yunani, Empire Park, Taman Parahyangan, Taman Imperial Golf Estate, The Beverly, La Vanoise Village, Northridge & Lake Side Homes, and Bali Hill site plans.

Regarding the execution of the ruling, the Chair of the Bandung PTUN had summoned the Bogor Regent to provide testimony at the hearing on Tuesday, 7 April 2026, at the Bandung PTUN. However, the official summons letter had not yet been received, so the Regent did not attend the said hearing as there was no administrative basis to comply with the summons.

Subsequently, the Chair of the Bandung PTUN sent another hearing summons on Tuesday, 14 April 2026. In response to this summons, the Bogor Regent, through the Legal Cooperation and Assistance Section, attended and provided official testimony at the Bandung PTUN.

During that hearing, the Chair of the Bandung PTUN also ordered the Bogor Regent to appear again at the hearing on 20 May 2026, bringing documents related to the execution of the ruling.

The Bogor Regency Government emphasises that steps to implement the PTUN ruling have been and are being taken. These include administrative actions in managing PSU specifically on the Taman Victoria site plan, for which Certificate of Right to Use No. 38 has been issued in the name of the Bogor Regency Government covering 34,160 square metres.

In addition, the Bogor Regency Government has carried out guidance and supervision measures for the handover of PSU in the Sentul City Housing Estate in Bogor Regency on the 14 site plans as mandated by the court ruling.

All progress and steps in executing the ruling will be officially reported by the Legal Cooperation and Assistance Section, as the regent’s representative, at the continuation hearing on 20 May 2026 at the Bandung PTUN, in accordance with the directives of the Chair of the Bandung PTUN.
