Banjarbaru Land Office Urged to Expedite Execution of Court Ruling

A resident of Banjarmasin City, who went viral some time ago, is once again questioning the slow response of the Banjarbaru City Land Office regarding legal certainty over a land issue. David Pangestu stated that to date, the Banjarbaru City Land Office has not provided an official response to a letter sent on 25 May 2026 requesting an explanation regarding the non-execution of the State Administrative Court Ruling concerning the object of Freehold Certificate (SHM) Number 10141 located on Jalan Aneka Tambang, Cempaka Village, Cempaka District, Banjarbaru City. The submission of the letter was a follow-up to the directive of the Ombudsman of the Republic of Indonesia, South Kalimantan Representative, during a meeting held on 21 May 2026. On that occasion, David submitted a report of alleged maladministration regarding the non-execution of a court ruling that has permanent legal force (inkracht). The report was received directly by the Head of the Ombudsman RI South Kalimantan Representative, Hadi Rahman. The letter addressed to the Banjarbaru City Land Office specifically requested an explanation regarding the non-execution of Supreme Court Ruling Number 103K/TUN/2020 dated 9 March 2020, which has been reinforced by a certificate of permanent legal force and the Execution Decree of the Banjarmasin State Administrative Court Number 34/PEN-EKS/2018/PTUN.BJM. According to David, up until the end of the term of office of the Head of the Banjarbaru City Land Office, Ahmad Suhaimi, and the inauguration of the new official, Riyanto S. Tosse, there has been no written response or administrative explanation to the letter that was submitted. “We have pursued the administrative mechanism in accordance with the Ombudsman’s direction by sending an official letter to the Banjarbaru City Land Office. However, to date there has been no written response explaining the status of the execution of the court ruling or the administrative follow-up that has been carried out,” said David Pangestu on Thursday, 18 June 2026. David hopes the Ombudsman RI South Kalimantan Representative will continue to supervise the resolution process of this issue to ensure administrative and legal certainty for the parties. He also hopes the new Head of the Banjarbaru City Land Office, Riyanto S. Tosse, can immediately evaluate the status of the handling of the case in question and provide an official explanation regarding the follow-up to the execution of the court ruling that has permanent legal force.
