Bandung City Regional Parliament Completes Social Welfare Implementation Regulation Draft
The Special Committee (Pansus) 12 of the Bandung City Regional Parliament (DPRD) has completed discussions on a draft regional regulation (Raperda) concerning the implementation of social welfare. The regulatory process is currently in the phase of consultation with relevant ministries and evaluation at the Ministry of Law and Human Rights (Kemenkumham).
Susanto Triyogo Adiputro, S.S.T., M.T., a member of Pansus 12 of the Bandung City DPRD, stated that substantively the discussions have been completed, with only harmonisation and evaluation stages remaining before it is established as a regional regulation (Perda).
“Alhamdulillah the discussion is complete. We only await the consultation process with the ministries and subsequent evaluation at the Kemenkumham,” he said.
According to Susanto, this Raperda has comprehensive scope, encompassing the responsibilities and authority of the local government, implementation of social welfare, the institutional framework of Social Welfare Institutions (LKS), regulation of Money and Goods Collection (PUB), Free Prize Draws (UGB), licensing, information systems, coaching, supervision, monitoring, evaluation and financing.
“This regulation is formulated as a derivative of several recent Ministry of Social Affairs Regulations (Permensos) to ensure that implementation in the region has a strong legal basis and is aligned with national provisions,” he stated.
Susanto noted that regarding Money and Goods Collection (PUB), this Raperda refers to Ministry of Social Affairs Regulation Number 8 of 2024. Several provisions incorporated into the Regional Regulation include matters concerning licensing mechanisms and administrative sanctions.
Furthermore, reporting obligations for PUB implementers are also regulated, including the obligation to attach documentation of public accountant audit results for fundraising exceeding Rp 500 million, as well as documentation of fund implementation and distribution.
“Reporting is an important part to ensure transparency and accountability,” he stated.
The PKS politician explained that for Social Welfare Institutions (LKS), the regulation in this Raperda is a derivative of Ministry of Social Affairs Regulation Number 5 of 2024. The main focus is strengthening the pattern of monitoring and evaluation by the Regional Social Service regarding the operations and governance of LKS.
“With this regulation, the local government has a clearer basis for providing guidance and supervision to social institutions operating in its territory,” he said.
Meanwhile, Susanto continued, regulations concerning Free Prize Draws (UGB) refer to Ministry of Social Affairs Regulation Number 3 of 2024.
