Bahar bin Smith assault victim rejects settlement, calls for immediate detention of suspects

TANGERANG, KOMPAS.com - The assault and gang assault by Bahar bin Smith against Banser member Rida is described as not something that can be settled through restorative justice (RJ). The victim’s lawyer, Suhendar, said the act constitutes a crime against public order, which cannot be resolved through a peaceful settlement. ‘Assault, gang assault, and deprivation of liberty fall into the category of crimes against public order, so restorative justice is forbidden,’ Suhendar said at the Metro Tangerang City Police Headquarters on Tuesday. Bahar bin Smith has been repeatedly involved in legal trouble, so restorative justice cannot be applied. ‘So for those who are recidivists or who have previously committed crimes, RJ does not apply,’ he added. The rejection is also based on the victim’s position that they want the legal process to continue until a court verdict is issued. ‘From the victim’s side, they have stated that they want the legal process to run until there is a court ruling. So there is no restorative justice,’ he explained. In addition to opposing a settlement, the victim’s side also asked investigators to detain the perpetrators immediately, including Bahar bin Smith, who is said to still be at large. ‘We request their immediate detention because today they are still at large,’ he said. ‘Under detention rules, if there is a possibility of influencing witnesses or destroying evidence, they should be detained immediately,’ he added. Bahar bin Smith’s lawyer, Ichwan Tuankotta, said the request was submitted to the Metro Tangerang City Police after Bahar underwent a series of interrogations as a suspect for more than 24 hours. ‘We also filed a request for peace or mediation, restorative justice,’ Ichwan said at the Metro Tangerang City Police Headquarters on Wednesday (11 February 2026). In addition, Bahar also expressed an apology to the victim and to GP Ansor via a video documented by the Metro Tangerang City Police.
