Auditor Applies Planned Assault Article in Andrie Case

The Head of the Military Auditor 07-II Jakarta, Colonel Corps of Law (Chk) Andri Wijaya, stated that the examination of the formal and material requirements of the case file regarding the acid splashing against Kontras activist Andrie Yunus has been completed. Currently, the file is being prepared for the submission of the minutes of opinions and legal recommendations to the Case Submitting Officer (Papera), as the basis for issuing the Case Submission Decision Letter (Skeppera). “We are applying layered articles in this case,” Andri said via WhatsApp message on Monday, 13 April 2026. According to Andri, the layered articles include Article 469 paragraph (1) of the Criminal Code (KUHP) juncto Article 20 letter c KUHP. This provision threatens the perpetrator with a maximum prison sentence of three years, either as the main perpetrator or as a participant (medeplichtige). In addition, the auditor also applies Article 468 paragraph (1) KUHP juncto Article 20 letter c KUHP, as well as Article 467 paragraphs (1) and (2) juncto Article 20 letter c KUHP. Article 468 paragraph (1) regulates assault resulting in serious injuries with a maximum penalty of eight years. Meanwhile, Article 467 regulates planned assault, with a threat of four years imprisonment in paragraph (1) and seven years if it causes serious injuries as regulated in paragraph (2). On the other hand, the Advocacy Team for Democracy (TAUD), as the victim’s legal representatives, rejects if this case is only charged as serious assault. TAUD member Gema Gita Persada assesses that the application of those articles does not yet reflect the entire incident. Based on a joint study with several experts, they suspect there are elements of attempted premeditated murder in this case. TAUD also included allegations of terrorism offences in the type B report submitted to the National Police Criminal Investigation Agency. That step refers to President Prabowo Subianto’s statement which called this incident a terrorism offence. The acid splashing incident occurred on 12 March 2026 on Jalan Salemba I–Talang, Central Jakarta. At that time, Andrie Yunus was attacked with corrosive chemical liquid while passing through the location. Medical records show that the Deputy Coordinator of Kontras suffered burns over more than 20 percent. The TNI Military Police Centre stated that there are four perpetrators in this case, namely NDP, SL, BHW, and ES. They come from the air and sea branches, with ranks of captain, first lieutenant, and second sergeant respectively.
