The Attorney General’s Office (Kejagung) has confirmed that the case of alleged corruption in the management of mining operations at PT Asmin Koalindo Tuhup (AKT), owned by Samin Tan, in Murung Raya Regency, Central Kalimantan, is being investigated using the latest Criminal Procedure Code (KUHAP). Although the corrupt actions began in 2017, the investigation adheres to the new provisions.

“It follows the rules of the new Criminal Code, the transitional rules,” said Director of Investigations at the Deputy Attorney General for Special Crimes of Kejagung, Syarief Sulaeman Nahdi, at the Kejagung office in South Jakarta on Saturday, 28 March 2026.

Syarief explained that the applicable KUHAP is determined by the date the investigation and prosecution are conducted. Therefore, the case implicating PT AKT owner Samin Tan cannot follow the old KUHAP.

“So if we conduct the investigation in 2026, even though the events occurred before 2026, it still uses the new Criminal Code. That’s how the transitional rules work,” Syarief stated.

Founder of PT AKT, Samin Tan (ST), has been named a suspect in this case. Investigators have detained Samin Tan for the initial 20 days.

In this case, Samin Tan, as the beneficial owner of AKT, failed to fulfil his obligation to pay the fine demanded by the PKH Task Force for the misuse of mining land.

Samin Tan’s company held a Coal Mining Business Agreement (PKPB2B) permit that expired in 2017. However, the company continued excavating the mining site until 2025.

This illegal activity was detected by the PKH Task Force, leading to a demand for fine payment. Instead of paying, Samin Tan stubbornly attempted to deceive law enforcement by using invalid permit documents.

Kejagung suspects collaboration between Samin Tan and related officials who abused their authority to grant illegal mining permits. In this matter, the state suffered losses of Rp4,248,751,390,842.
