Attorney General's Office Files Cassation Appeal Against Acquittal of Activist Delpedro and Others
Jakarta, VIVA – The Public Prosecutors (JPU) of the Attorney General’s Office have filed a cassation appeal against the acquittal verdict for Delpedro Marhaen, Director of the Lokataru Foundation, and three other activists in the incident involving a chaotic demonstration in August 2025.
The filing of the cassation is listed on the official website of the Case Tracking Information System (SIPP) of the Central Jakarta District Court, with case number 742/Pid.Sus/2025/PNJkt.Pst. It states that the public prosecutor is Tri Yanti Merlyn Christin Pardede.
Meanwhile, the defendants in this case include Delpedro Marhaen Rismansyah, Muzaffar Salim, Syahdan Husein, and Khariq Anhar.
Regarding this matter, the Head of the Public Prosecution Information Centre of the Attorney General’s Office, Anang Supriatna, stated that the cassation was filed because the case was transferred on 9 December 2025.
“The reason the JPU filed the cassation is because the case was transferred on 9 December 2025,” said Anang to reporters on Tuesday, 7 April 2026.
Meanwhile, Anang explained that the trial undergone by Delpedro and others still uses the old Criminal Procedure Code (KUHAP).
“Based on the transitional provisions as per Article 361 letter c of Law Number 20 of 2025 on the Criminal Procedure Code, it states that criminal cases that have already been transferred to the court and the examination process has begun shall continue to be examined, tried, and decided based on the provisions in Law Number 8 of 1981 on Criminal Procedure (State Gazette of the Republic of Indonesia Year 1981 Number 76, Supplement to the State Gazette of the Republic of Indonesia Number 3209), except for the review process which follows the provisions of the 2025 KUHAP,” explained Anang.
Furthermore, Anang stated that therefore, for the case involving Delpedro Marhaen Rismansyah and others, which was decided with an acquittal (vrijspraak) during the examination period, the legal remedy still refers to Law Number 8 of 1981 on Criminal Procedure (old KUHAP).
“Thus, for that case, a cassation legal remedy is pursued,” he clarified.
Previously, the Central Jakarta District Court issued a surprising decision in the case implicating Delpedro Marhaen, Director of the Lokataru Foundation, and three other activists related to the chaotic demonstration in August 2025.
The panel of judges decided to acquit all defendants from the prosecutor’s charges. The verdict was read out in a hearing held on Friday, 6 March 2026.
The defendants were not proven to have committed the acts as charged by the public prosecutor.
“Acquitting the defendants from the Public Prosecutor’s charges,” said the Chief Judge of the Panel, Harika Nova Yeri.
