Appointed Minister by Prabowo, Jumhur Claims He Was Never Convicted
Minister of Environment Jumhur Hidayat has stated that he has never held the status of a convicted person. Jumhur previously faced a legal case in 2020 related to his opposition to the Job Creation Law (Ciptaker).
“I was not convicted; I was tried with a demand of 2 years, after which the law was annulled by the Constitutional Court. That law is no longer in effect,” Jumhur said at the Presidential Palace in Jakarta on Monday (27/4).
“So I was truly never a suspect because the law no longer exists. During the process, the law was annulled,” he added.
In 2020, Jumhur faced legal proceedings. His firm stance in leading the rejection of the Omnibus Law on Job Creation, which was deemed detrimental to workers and indigenous communities, resulted in his detention.
He was subsequently sentenced to 10 months in prison related to a case of spreading false news (hoaxes) regarding the Job Creation Law via Twitter.
Thereafter, the Job Creation Law was challenged at the Constitutional Court. In its decision, the Constitutional Court granted part of the judicial review petition for Law No. 6 of 2023 on the Establishment of Government Regulation in Lieu of Law No. 2 of 2022 on Job Creation (Job Creation Law).
The Constitutional Court requested that the law’s creators promptly form a new Labour Law and separate or exclude provisions regulated in Law No. 6 of 2023.
The panel of judges assessed the possibility of norm overlap between Law No. 13 of 2003 on Manpower and the Job Creation Law.
