Appellate Court Increases Luhur Budi's Sentence to 6 Years in Rp 348 Billion Corruption Case
The sentence for former General Director of PT Pertamina (Persero) from 2012 to 2014, Luhur Budi Djatmiko, has been increased to six years in prison at the appellate level. Luhur was previously sentenced to 1.5 years in prison.
“Imposing a prison sentence on the Defendant of six years and a fine of Rp 500 million, with the provision that within one month after the judgement gains legal force, the Defendant’s assets shall be seized and auctioned by the Public Prosecutor to pay the fine, and if the fine is not paid, it shall be replaced with imprisonment of 140 days,” states the appellate decision number 12/PID.SUS-TPK/2026/PT DKI, as seen on the SIPP website of the Central Jakarta District Court, Wednesday (6/5/2026).
The appellate judges also imposed an additional sentence on Luhur. He is required to pay restitution of Rp 348.6 billion.
“With the provision that within one month after the judgement gains legal force, if the Defendant does not pay, the Defendant’s assets shall be seized and auctioned by the Public Prosecutor to cover the restitution, and if the Defendant does not have sufficient assets to pay the restitution, he shall be sentenced to four years’ imprisonment,” the judge stated.
Previously, the judge at the Central Jakarta Corruption Court sentenced Luhur Budi to 1.5 years in prison. The Central Jakarta Corruption Court judge also fined Luhur Rp 500 million.
The first-instance judge at the Central Jakarta District Court stated that the state financial loss in this case amounted to Rp 348.6 billion. The judge imposed the payment of the loss on the enriched companies, namely PT Bakrie Swastika Utama and PT Superwish Perkasa.
The sentence at the Central Jakarta District Court level was lower than the prosecution’s demand. Luhur Budi was demanded five years in prison. Luhur was also demanded a fine of Rp 750 million subsidiary 165 days’ imprisonment, and restitution of Rp 348.6 billion subsidiary six months’ imprisonment.
Luhur Budi was charged with causing a Rp 348 billion loss to the state in a suspected corruption case related to the purchase of land in South Jakarta. The prosecutors outlined the state loss in this case through their indictment.
“Enriching himself or others or a corporation, namely the corporations PT Bakrie Swastika Utama and PT Superwish Perkasa, by Rp 348,691,016,976, which harms the state finances or economy by Rp 348,691,016,976,” the prosecutor stated when reading the indictment at the Jakarta Corruption Court, Thursday (16/10/2025).
The prosecutors stated that Luhur also directed the public appraisal service office to prepare a land valuation report for Rasuna Epicentrum as if it were free and clear. The recommended price in that direction was Rp 35,566,797.39 per square metre.
“Which was subsequently approved by the Board of Directors of PT Pertamina at a price of Rp 35,000,000 per square metre and directed that the final KJPP FAST report be made as if dated 7 March 2013, whereas the actual final KJPP FAST report was received on 26 September 2013,” he said.
The prosecutors stated that Luhur also signed the binding sale and purchase agreement (PPJB) for the land Lots 11A and 19 with PT Superwish Perkasa. However, according to the prosecutors, the land Lots 11A and 19 were not in free and clear condition.
