Andrie Yunus Case to Be Transferred to Military Court Tomorrow

The Military Prosecutor’s Office 07-II Jakarta has stated that it has received the Decision on the Handover of the Case (Skeppera) as the basis for preparing the Indictment in the acid attack case against activist Andrie Yunus. Head of the Military Prosecutor’s Office 07-II Jakarta, Colonel Corps of Law (Chk) Andri Wijaya, said the Skeppera was received on Wednesday, 15 April. Therefore, the handover will be carried out soon. “The case file will be transferred to the Military Court 08-II Jakarta tomorrow morning,” Andri told Tempo on Wednesday. On the previous Monday, the Military Prosecutor’s Office 07-II Jakarta stated that the case file for the Andrie Yunus case had been declared complete both formally and substantively. After the minutes and legal opinions were given to the Case Handover Officer, the Prosecutor’s Office would wait for the issuance of the Skeppera. The Military Prosecutor’s Office 07-II Jakarta also stated that it is applying layered articles in the indictment for Andrie’s case. The layered articles referred to are Article 469 paragraph (1) of the Criminal Code (KUHP) in conjunction with Article 20 letter c of the KUHP. Then, Article 468 paragraph (1) of the KUHP in conjunction with Article 20 letter c of the KUHP, and Article 467 paragraph (1) in conjunction with paragraph (2) of the KUHP in conjunction with Article 20 letter c of the KUHP. Article 468 paragraph (1) of the KUHP regulates acts of assault causing serious injuries with a maximum prison sentence of eight years. Meanwhile, Article 467 paragraphs (1) and (2) regulate premeditated assault. The penalty for this article is a maximum of four years’ imprisonment under paragraph (1), and a maximum of seven years’ imprisonment under paragraph (2) if the assault causes serious injuries. Previously, the Advocacy Team for Democracy (TAUD)—Andrie Yunus’s legal representatives—rejected if the perpetrators of the acid attack on their client were only charged with serious assault. TAUD member Gema Gita Persada said that the application of that article does not yet reflect the overall incident. Because, based on a legal study conducted with several experts, there is strong suspicion of attempted premeditated murder in Andrie’s case. Moreover, in the type B report to the National Police Criminal Investigation Agency, TAUD also included the article on terrorism offences in Andrie’s case. The inclusion of this article is in line with President Prabowo Subianto’s statement assessing Andrie’s case as a terrorism offence. Andrie Yunus was doused with corrosive chemical liquid on 12 March while passing through Jalan Salemba I-Talang, Central Jakarta. Medical records state that the Deputy Coordinator of Kontras suffered burns of more than 20 percent due to the attack carried out by TNI BAIS personnel. Based on information from the Military Police Centre, there are four perpetrators of the acid attack. They are NDP, SL, BHW, and ES, from the air and sea branches. NDP holds the rank of captain, SL and BHW hold the rank of first lieutenant, while ES holds the rank of second sergeant.
