Surabaya (ANTARA) - A child who loses their parents does not always lose their shelter. Yet without legal recognition, they often lose something invisible to the eye: certainty over their rights.

Schooling, healthcare services, civil registration, and legal protection can become a winding path when a child’s guardianship status remains unclear.

In many regions, the plight of orphans, abandoned children, or children living with substitute families is still often understood as merely a social matter. In fact, behind these affectionate relationships lies a legal dimension that determines a child’s future.

Who has the right to represent them before the law, manage their education, access public services, and protect their property rights are questions requiring both administrative and juridical answers.

For this reason, the Surabaya municipal government’s move to support the Mass Child Guardianship Programme initiated by the East Java High Prosecutor’s Office brings a new perspective. The programme is not merely about handing guardianship documents to 75 children, but about strengthening the foundations of child protection through legal certainty.

The programme, a collaboration between the East Java High Prosecutor’s Office, the District Court, the Religious Court, and the Surabaya municipal government, demonstrates that child protection cannot be resolved by a single institution. The state is present through cross-sector cooperation so that children’s rights do not stop at compassion, but are guaranteed by law.

Without a court ruling, a guardian who has cared for a child for many years does not necessarily hold full authority to make important decisions concerning that child’s future.

In practice, problems can arise when dealing with school enrolment, healthcare services, changes in civil registration, and various other legal matters.

This is where the strategic value of the Mass Child Guardianship Programme lies. The guardianship documents provide certainty regarding guardians’ rights and responsibilities while strengthening the child’s legal position. Protection that previously depended on family ties is transformed into protection with a permanent legal basis.
