AI development presents new challenges in judicial process

Jakarta (ANTARA) - Deputy Minister of Communication and Digital Affairs Nezar Patria has stated that the development of artificial intelligence (AI) technology also presents new challenges in the legal field, including in the judicial process.

Speaking at the National Law Forum in Central Jakarta on Monday (24/8), he said that generative AI is now capable of producing what is known as synthetic reality in various formats.

“This becomes a significant matter when we see that in judicial processes there is evidence submitted in the form of recordings, videos, and photographs,” he said, as quoted in a ministry press release confirmed on Tuesday.

According to him, AI’s ability to generate video, photos, and audio that resemble real events presents challenges in the authentication process.

“This is quite an important test. How can such evidence convince the panel of judges? How can the court forum authenticate the evidence submitted in court?” he said.

Such conditions require those working in the legal field to improve their knowledge of digital technology and AI developments.

AI can be utilised to help systematically prepare court documents, conduct legal analysis, and improve the delivery of legal services to the public.

“For example, the Supreme Court has used artificial intelligence technology to create a sort of smart panel to process the administration of incoming cases, which number in the tens of thousands,” Nezar said.

Nezar emphasised that AI is only used to help facilitate the judicial process, not to replace the role of humans in the judicial process.

“The one who decides remains the judge, not AI. It remains the human, not AI. AI only helps,” he said.
